<br /> 21 <br /> ORDINANCE 1985-135 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE <br /> CITY OF SAN MARCOS, TEXAS, AMENDING <br /> SECTION 2-43 OF DIVISION 2, ENTITLED <br /> "TEXAS MUNICIPAL RETIREMENT SYSTEM" OF <br /> ARTICLE III, ENTITLED "CIVIL SERVICE AND <br /> EMPLOYEE BENEFITS" OF CHAPTER 2 OF THE <br /> CODE OF ORDINANCES OF SAID CITY TO N~END <br /> THE DATE ON WHICH CALCULATIONS OF UPDATED <br /> SERVICE CREDITS ARE BASED, UNDER THE ACT <br /> GOVERNING THE TEXAS MUNICIPAL RETIREMENT <br /> SYSTEM, FOR SERVICE PERFORMED BY <br /> QUALIFYING MEMBERS OF SUCH SYSTEM IN THE <br /> EMPLOYMENT OF SAID CITY AND TO AMEND THE <br /> DATE ON WHICH CALCULATIONS OF UPDATED <br /> SEEVICE CREDITS ARE BASED UNDER SAID ACT <br /> FOR SERVICE PERFORMED BY QUALIFYING <br /> MEMBERS OF SUCH SYSTEM WHO HAVE <br /> UNFORFEITED CREDIT FOR PRIOR SERVICE <br /> AND/OE CURRENT SERVICE WITH OTHER <br /> PARTICIPATING MUNICIPALITIES BY REASON OF <br /> PREVIOUS SERVICE AND WHO WERE <br /> CONTRIBUTING MEMBERS ON JANUARY 1, 1985; <br /> AMENDING SECTION 2-44(b) OF SAID DIVISION <br /> OF SAID ARTICLE OF SAID CHAPTER OF SAID <br /> CODE TO AMEND THE DATE ON WHICH <br /> CALCULATIONS OF THE INCREASE IN <br /> RETIREMENT ANNUITIES ARE BASED; AND <br /> DECLARING AN EMERGENCY. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS: <br /> SECTION 1. That Section 2-43 of Division 2 of <br /> Article III of the Code of Ordinances of the City of San <br /> Marcos, Texas, is hereby amended to read as follows: <br /> Sec. 2-43. Authorization of updated service credit. <br /> (a) On the terms and conditions set out in Sections <br /> 63.403 of Title 110B, Revised civil Statutes of <br /> Texas, 1925, as amended, each member of the Texas <br /> Municipal Retirement System who has current <br /> service credit or prior service credit in said <br /> System in force and effect on the 1st day of <br /> January, 1986, by reason of service in the <br /> employment of the City of San Marcos, and on such <br /> date has at least 36 months of credited service <br /> with said System, shall be and is hereby allowed <br /> "Updated Service Credit" (as that term is defined <br /> in subsection (d) of Section 63.402 of said <br /> Title) in an amount that is 100% of the "base <br /> Updated Service Credit" of the member (calculated <br /> as provided in subsection (c) of Section 63.402 <br /> of said Title). The Updated Service Credit <br /> hereby allowed shall replace any Updated Service <br /> Credit, prior service credit, special prior <br /> service credit, or antecedent service credit <br /> previously authorized for part of the same <br /> service. <br />
