<br /> 26 <br /> RESOLUTION 1985-116R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br /> OF SAN MARCOS, TEXAS, APPROVING THE 'rERMS AND <br /> CONDITIONS OF A PROPOSED SUPPLEMENTAL <br /> AGREEMENT NO. 1 TO THAT LEASE AGREEMENT <br /> BETWEEN SAID CITY AND THE UNITED STATES OF <br /> AMERICA REPRESENTED BY THE FEDERAL AVIATION <br /> ADMINISTRATION DATED MARCH 25, 1985, TO <br /> PROVIDE SAID U.S.A. FEDERAL AVIATION <br /> ADMINISTRATION THE REQUIRED LAND FOR A REVISED <br /> LOCATION OF THE MALSR ACCESS ROAD AND <br /> FRANGIBLE TOWER AND THE ADDITION OF A 10 FOOT <br /> BY 100 FOOT LOW WATER CROSSING OVER THE <br /> DRAINAGE DITCH ALONG THE SIDE OF STATE HIGHWAY <br /> 21 AT THE SAN MARCOS MUNICIPAL AIRPORT; <br /> AUTHORIZING THE MAYOR TO EXECUTE SAID <br /> AGREEMENT AND ANY AND ALL OTHER DOCUMENTS AND <br /> INSTRUMENTS INCIDENT TO THE PURPOSES THEREOF <br /> ON BEHALF OF SAID CITY; AND DECLARING AN <br /> EFFECTIVE DA'rE. <br /> WHEREAS, on March 25, 1985, the City of San Marcos, Texas, <br /> entered into a lease agreement with the United States of America <br /> represented by the Federal Aviation Administration for lease of a <br /> parcel of land containing 2.923 acres out of that 132.65 acres out <br /> of the T.G. McGehee Survey, Hays County, Texas and the granting of <br /> a right-of-way for necessary facility sites for a medium intensity <br /> approach lighting system with alignment indicator lights, glide <br /> slope, localizer, middle marker and visual approach slope <br /> indicator and for installation of Runway 30 4-box visual approach <br /> slope indicators with necessary supporting cable rights-of-way, at <br /> the San Marcos Municipal Airport; and, <br /> WHEREAS, the said U.S.A. Federal Aviation Administration <br /> need s to revise the location of the MALSR access road and <br /> frangible tower and add a la-foot by lOa-foot low water crossing <br /> over the drainage ditch along the side of State Highway 21; and, <br /> WHEREAS, the City Council of said City hereby finds and <br /> determines it to be in the interest of the public health, safety <br /> and welfare to enter into said Supplemental Agreement No. 1; now, <br /> therefore, <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> PART 1. That the terms and conditions of proposed <br /> Supplemental Agreement No. 1 to that lease agreement between said <br /> City and the United States of America represented by the Federal <br /> Aviation Administration dated March 25, 1985, to provide said <br /> U.S.A. Federal Aviation Administration the required land for a <br /> revised location of the MALSR access road and frangible tower and <br /> the addition of a la-foot by lOa-foot low water crossing over the <br /> drainage ditch along the side of State Highway 21 at the San <br /> Marcos Municipal Airport, a copy of said Agreement being attached <br /> hereto and incorporated herein for all purposes, are hereby in all <br /> things approved. <br /> PART 2. That the Mayor, Emmie Craddock, be and she is <br /> hereby, authorized to execute said Agreement and any and all other <br /> documents and instruments incident to the purposes thereof on <br /> behalf of said City. <br /> PART 3.
