<br />20 <br /> <br />ORDINANCE 1984-8 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, AMENDING SECTION 3 OF <br />THAT ORDINANCE WHICH REGULATES AND RESTRICTS <br />THE LOCATION AND USE OF BUILDINGS, STRUCTURES <br />AND LAND, DATED SEPTEMBER 29, 1980 (VOL. 54) <br />BY ZONING 3.39 ACRES, MORE OR LESS, OF LAND <br />AREA PREPARED FROM PUBLIC RECORD INFORMATION <br />OUT OF THE J.M. VERfu~ENDI LEAGUE NO.1, HAYS <br />COUNTY, TEXAS, BEING A PORTION OF THAT 82.06 <br />ACRE TRACT DESCRIBED IN A DEED FROM W.B. <br />., WILLIAMS TO TOM E. TURNER DATED JULY 14, 1983, <br />AND RECORDED IN VOLUME 397, PAGE 824 OF THE <br />HAYS COUNTY DEED RECORDS, A/K/A 2500-2600 <br />HUNTER ROAD, FROM "AO" (AGRICULTURAL-OPEN <br />SPACE DISTRICT) TO "c" (COMMERCIAL DISTRICT). <br /> <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That the following described piece of real <br />property located in San Marcos, Hays County, Texas, which was <br />classified "AO" (Agricultural-Open Space District) upon its <br />annexation to the City of San Marcos on June 27, 1983, hence- <br />forth shall be zoned as follows: <br /> <br />3.39 ACRES, MORE OR LESS, OF LAND AREA PREPARED <br />FROM PUBLIC RECORD INFORMATION OUT OF THE J.M. <br />VERAMENDI LEAGUE NO.1, HAYS COUNTY, TEXAS, BEING <br />A PORTION OF THAT 82.06 ACRE TRACT DESCRIBED IN <br />A DEED FROM W.B. WILLIAMS TO TOM E. TURNER DATED <br />JULY l4, 1983 AND RECORDED IN VOLUME 397, PAGE <br />824 OF THE HAYS COUNTY DEED RECORDS AND BEING MORE <br />PARTICULARLY DESCRIBED BY METES AND BOUNDS AS FOLLOWS: <br /> <br />CO~ENCING at an iron rod found at the south corner <br />of the aforereferenced 82.06 acre tract and the east <br />corner of a 96.71 acre tract described in a deed <br />from Bruce F. Harper, et al, to Tetco, Inc. dated <br />March 22, 1983 and recorded in Volume 390, Page 542 <br />of the Hays County Deed Records being in the north- <br />west line of F.M. Hwy No. 2439; <br /> <br />THENCE along the common northwest line of F.M. <br />Hwy No. 2439 and the southeast line of the 82.06 <br />acre tract, the following two courses: <br /> <br />1. N45°42'39"E 305.85 feet to a Texas Highway <br />Department concrete monument found at <br />Engineer's Station 126+03.9 and <br />2. N46°54'30"E 140.27 feet to the PLACE OF <br />BEGINNING; <br /> <br />THENCE leaving the PLACE OF BEGINNING and entering <br />the 82.06 acre tract, the following three courses; <br /> <br />1. N43°05'30"W 555.49 feet to an angle point, <br />2. N71o01'20"E 331.63 feet to an angle point and <br />3. S43°05'30"E 420.00 feet to a point lying in <br />the northwest line of F.M. Hwy No. 2439; <br /> <br />THENCE with the northwest line of F.M. Hwy 2439 S46° <br />54'30"W 302.69 feet to the PLACE OF BEGINNING. There <br />are contained within these metes and bounds 3.39 acres, <br />more or less, of land area prepared from public records <br />during September, 1983 by David C. Williamson, R.P.S. <br />#4190 Dabney-Byrn and Associates of San Marcos, Texas <br />a/k/a 2500-2600 Hunter Road, from "AO" (Agricultural- <br />Open S:pace District) to "c" (Commercial District). <br /> <br /> <br />SECTION 2. That this Ordinance shall be in full force and <br />effect ten (10) days from and after passage and publication in <br />a newspaper of general circulation in the area. <br />
