58 THE STATE OF TEXAS SPECIAL WARRANTY DEED COUNTY OF HAYS KNOW ALL PERSONS BY THESE PRESENTS: That the City of San Marcos, Texas, a municipal corpora- tion organized and existing under and by virtue of the laws of the State of Texas, of the County of Hays and the State of Texas, for and in consideration of the sum of TEN DOLLARS ($10.00) and other valuable consideration to the undersigned paid by the Grantee herein named, the receipt of which is hereby acknowledged, has GRANTED, SOLD AND CONVEYED and by these presents does GRANT, SELL AND CONVEY unto John J. Stokes, 1122 Seguin Highway, San Marcos, Hays County, Texas, all of the CityJs right~ titlé and interest in the following desc~ib~q ~~gl property in Hays County, Texas, to-wit: All that portion of an alley in the z. Williamson Third Addition to the City of San Marcos, an alley dedicated to the public as shown on the plat of record in Volume 59, Page 545, Hays County Deed Records, which is located between Hamilton Street and Nevada Street, being 150 feet long and 15 feet wide and being that portion which abuts lots 24, 25, 26, 37, 38 and 39 as shown on said plat; and All that portion of Nevada Street in the City of San Marcos, Texas, a street dedicated to the public on the plat of the Z. Williamson Third Addition to said City recorded in Volume 59, Page 545, Hays County Deed Records, which is located between Indiana (formerly Indian) Street and an alley between Hamilton Street and Perkins Street (a portion of the former McNeill Road), being 160 feet long and 50 feet wide and being that portion which is located between lots 68 and 69 as shown on said plat; TO HAVE AND TO HOLD the above described premises, together with all and singular the rights and appurtenances thereto in anywise belonging, unto the said Grantee, his heirs and assigns forever; and it does hereby bind itself, its successors and assigns, to WARRANT AND FOREVER DEFEND all and singular the said premises unto the said Grantee, his heirs and assigns, against every person whomsoever lawfully claiming or to claim the same or any part thereof, by, through or under it, but not otherwise.
