-ll- month, shall be deposited to a fund, separate and apart from said Revenue Fund and all other funds of the city, to be designated as "city of San Marcos Sewer System Capital Improvement Fund". Said Fund shall be established and maintained at an official depository bank of the City and shall be used for the purposes stated in Section 30-40 of this Ordinance. Section 30-51. Severability. If any provision of this Ordinance (Division 4 of Chapter 30) or the application thereof to any person or circumstances is held invalid, such invalidity shall not affect any other provisions of this Ordinance (Division 4 of Chapter 30) which can be given effect without the invalid provisions of this Ordinance (Division 4 of Chapter 30). SECTION 2. That all other ordinances or parts of ordinances in conflict with the provisions of this Ordinance are hereby repealed except as expressly provided for herein. SECTION 3. That the City Secretary is directed to cause the caption of this Ordinance to be published in a newspaper of general circulation in the City of San Marcos according to law. SECTION 4. That this Ordinance shall be in effect ten days from and after its passage and publication in a newspaper of general circulation in the area; and upon such effective date, the Ordinance of the City Council which established a temporary moratorium on the receipt of applications for building permits which include plumbing within the corporate limits of the City of San Marcos shall be immediately and automatically rescinded.
