Hankins <br /> City Attorney <br />SUBJECT: Allegation of Illegal Meeting Held Tuesday, February 7, <br /> 1984 <br />DATE: February 23, 1984 RE: <br /> In a newspaper column in the San Marcos Daily Record on <br /> Sunday, February 19, 1984, Bill Coddington wrote that the <br /> workshop held on February 7 was not noticed as required by <br /> the Open Meetings Act. Specifically, Coddington said that <br /> the public was never notified of the time change from 6: 30 <br /> p.m. to 5:30 p.m., in violation of the Open Meetings Act. <br /> From conversations with the City Manager and the City <br /> Secretary I have learned that on Monday, February 6, the <br /> Superintendent of Schools for SMCISD notified the City <br /> Manager that the meeting scheduled on Tuesday night would <br /> conflict with a Chamber of Commerce banquet that was to <br /> start at 7:00 p.m. The Superintendent said that several <br /> school board members wanted to attend the Chamber banquet. <br /> The City Manager made arrangements to move the time of the <br /> meeting from 6:30 to 5:30 on February 7. <br /> The City Manager and the City Secretary caused the notice <br /> of the meeting with the time change to be published in the <br /> San Marcos Daily Record on February 7 in order to comply <br /> with Section 3.09 of the San Marcos City Charter that <br /> requires all meetings of the City Council not held at City <br /> Hall to be published "in one issue of a newspaper in <br /> general circulation in the City of San Marcos. " The City <br /> Secretary posted the time change at 1:15 p.m. on February <br /> 6, 1984. In addition, she notified members of the media <br /> who had previously requested such notifications. <br /> At the meeting on February 7, at least three members of <br /> the media were present along with Mr. Coddington and <br /> others mentioned in his article. <br />
