At such time as all of the Certificates are retired, or provision is made for their payment, money in the Interest and Sinking Fund if any, shall be transferred to the maintenance fund of the City, uníess then required by law to be transferred to some other fund or used for some other purpose, provided that any money held by the Paying Agent/Registrar which has been provided for the payment of interest or principal and not so utilized for any reason shall continue to be held by the Paying Agent/Registrar for a period of three calendar years, and if not claimed, the same shall be returned to the City. Section 26. PRINTED OPINION. The purchaser's obligation to accept delivery of the Certificates is subject to its being furnished a final opinion of Rick P. Fisher, Attorney at Law, approving such Certificates as to their validity, said opinion to be dated and delivered as of the date of delivery and payment for such Certificates. Printing of a true and correct copy of said opinion on the reverse side of each of said Certificates is hereby approved and authorized. Section 27. PUBLIC MEETING. It is officially found, determined, and declared that the meeting at which this Ordinance is adopted was open to the public and public notice of the time, place, and subject matter of the public business to be considered at such meeting, including this Ordinance, was given, all as required by the applicable provisions of Article 6252-17, Vernon's Texas Civil Statutes, as amended. Section 28. EMERGENCY DECLARATION. The fact that the proceeds from the sale of the Certificates are needed without delay for the acquisition of urgently needed facilities and properties creates an emergency and an urgent public necessity relating to the preservation of the purlic peace, health and safety requiring that the Charter rule which requires that ordinances be read on three separate days be dispensed with; said Charter rule is hereby accordingly dispensed with; and this Ordinance is passed as an emergency measure, to take effect and be in force and effect from and after its passage.
