<br /> 103 <br /> ~ <br /> CO <br /> ~ ORDINANCE 1984-28 <br /> - <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br /> OF SAN MARCOS, TEXAS, AMENDING SECTION 3 OF <br /> THAT ORDINANCE WHICH REGULATES AND RESTRICTS <br /> THE LOCATION AND USE OF BUILDINGS, STRUCTURES <br /> AND LAND, DATED SEPTEMBER 29, 1980 (VOL. 54) <br /> BY ZONING 49.57 ACRES OF LAND, HORE OR LESS, <br /> IN THE BENJAMIN J. WHITE SURVEY, THE THOMAS <br /> W. FORSYTH SURVEY AND THE LYDIA GLASCOW SURVEY, <br /> IN HAYS COUNTY, TEXAS, A/K/A 1921 RANCH ROAD <br /> 12, TO "PUD" (PLANNED UNIT DEVELOPHENT), 47.24 <br /> ACRES FROM "AO" (AGRICULTURAL-OPEN SPACE DIS- <br /> TRICT) AND 2.33 ACRES FROM "c" (COMMERCIAL <br /> DISTRICT). <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> SECTION 1. That the following described parcel of real property lo- <br /> cated in San Harcos, Hays County, Texas, 47.24 acres which was clas- <br /> sified "AO" (Agricultural-Open Space District) upon its annexation <br /> to the City of San Marcos on December 19, 1983, and 2.33 acres of <br /> which is presently zoned "c" (Commercial District) henceforth shall <br /> be zoned as follows: <br /> 49.57 acres of land, more or less, in the Benjamin J. White Survey, <br /> the Thomas W. Forsyth Survey and the Lydia Glascow Survey, Hays <br /> County, Texas, being a portion of that 14.58 acre Tract No. One and <br /> that 36.75 acre Tract No. Two conveyed by Stella Hageman to Kenneth <br /> V. Kraus by Deed dated May 1, 1979 and recorded in Volume 325, Page <br /> 498 of the Hays County Deed Records, and being more particularly <br /> described by metes and bounds as follows: <br /> COMMENCING at a point for the North corner of the 14.58 acre Tract <br /> No. One, the East corner of that 7.45 acre tract of land described <br /> in a Deed from Lucille Avey Schlameus, Et Al, to Carroll Walker dated <br /> June 7, 1973 and recorded in Volume 262, Page 70 of the Hays County <br /> Deed Records and the North corner of that 1.85 acre tract described <br /> in a Deed from Kenneth V. Kraus to Thomason Funeral Home, Inc. dated <br /> March 17, 1983 and recorded in Volume 390, Page 788 of the Hays <br /> County Deed Records, and being in the Southwest line of Ranch Road <br /> No. 12; <br /> THENCE with the common line of the Walker tract and the Thomason <br /> Funeral Home, Inc. tract S. 10° 30' W. 303.76 feet to an iron rod <br /> for the West corner of the Thomason Funeral Home, Inc. tract and <br /> a North corner and PLACE OF BEGINNING of this tract and being 300 <br /> feet from the Southwest line of Ranch Road No. 12; <br /> THENCE leaving the PLACE OF BEGINNING with the lines of the Thomason <br /> Funeral Home, Inc. tract, the following two courses: <br /> 1. S. 70° 57' 51" E. 240.00 feet to an iron rod for the <br /> South corner of the Thomason Funeral Home, Inc. tract; <br /> 2. N. 21° 56' 47" E. 300.00 feet to an iron rod in the <br /> common Southwest line of Ranch Road No. 12 and North- <br /> east line of the 14.58 acre Tract One; <br /> THENCE with the common line of Ranch Road No. 12 and Tract One, the <br /> following two courses: <br />
