103 ~ CO ~ ORDINANCE 1984-28 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND LAND, DATED SEPTEMBER 29, 1980 (VOL. 54) BY ZONING 49.57 ACRES OF LAND, HORE OR LESS, IN THE BENJAMIN J. WHITE SURVEY, THE THOMAS W. FORSYTH SURVEY AND THE LYDIA GLASCOW SURVEY, IN HAYS COUNTY, TEXAS, A/K/A 1921 RANCH ROAD 12, TO "PUD" (PLANNED UNIT DEVELOPHENT), 47.24 ACRES FROM "AO" (AGRICULTURAL-OPEN SPACE DIS- TRICT) AND 2.33 ACRES FROM "c" (COMMERCIAL DISTRICT). BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That the following described parcel of real property lo- cated in San Harcos, Hays County, Texas, 47.24 acres which was clas- sified "AO" (Agricultural-Open Space District) upon its annexation to the City of San Marcos on December 19, 1983, and 2.33 acres of which is presently zoned "c" (Commercial District) henceforth shall be zoned as follows: 49.57 acres of land, more or less, in the Benjamin J. White Survey, the Thomas W. Forsyth Survey and the Lydia Glascow Survey, Hays County, Texas, being a portion of that 14.58 acre Tract No. One and that 36.75 acre Tract No. Two conveyed by Stella Hageman to Kenneth V. Kraus by Deed dated May 1, 1979 and recorded in Volume 325, Page 498 of the Hays County Deed Records, and being more particularly described by metes and bounds as follows: COMMENCING at a point for the North corner of the 14.58 acre Tract No. One, the East corner of that 7.45 acre tract of land described in a Deed from Lucille Avey Schlameus, Et Al, to Carroll Walker dated June 7, 1973 and recorded in Volume 262, Page 70 of the Hays County Deed Records and the North corner of that 1.85 acre tract described in a Deed from Kenneth V. Kraus to Thomason Funeral Home, Inc. dated March 17, 1983 and recorded in Volume 390, Page 788 of the Hays County Deed Records, and being in the Southwest line of Ranch Road No. 12; THENCE with the common line of the Walker tract and the Thomason Funeral Home, Inc. tract S. 10° 30' W. 303.76 feet to an iron rod for the West corner of the Thomason Funeral Home, Inc. tract and a North corner and PLACE OF BEGINNING of this tract and being 300 feet from the Southwest line of Ranch Road No. 12; THENCE leaving the PLACE OF BEGINNING with the lines of the Thomason Funeral Home, Inc. tract, the following two courses: 1. S. 70° 57' 51" E. 240.00 feet to an iron rod for the South corner of the Thomason Funeral Home, Inc. tract; 2. N. 21° 56' 47" E. 300.00 feet to an iron rod in the common Southwest line of Ranch Road No. 12 and North- east line of the 14.58 acre Tract One; THENCE with the common line of Ranch Road No. 12 and Tract One, the following two courses:
