III STATE Texas WATERSHED Uoper San Marcos Rive1 AGREEMENT NO. UNITED STATES DEPARTMENT OF AGRICULTURE SOIL CONSERVATION SERVICE AGREEMENT FOR SERVICE THIS AGREEMENT made this 12 day of March , 19 ~ by and between the City of San Uarcos, hereinafter referred to as the City and the Soil Conservation Service, an agency of the Department of Agriculture, hereinafter referred to as the Service, WITNESSETH THAT: WHEREAS, under the provisions of the Flood Cöntrol Act of 1944, the City and the Service agreed to a work plan on the above watershed, which in part provides for the construction of a basic recreational facility along the San Marcos River, NOW THEREFORE, the City and the Service, in consideration of their mutual promises to each other hereinafter set forth, herein agree as follows: A. It is agreed that the following described engineering services are to be prepared by a private engineering firm at an estimated cost of $20,000-.00. Construction plans and specifications for the recreational facilities B. The City will: 1. Provide SO percent of the cost of engineering services described in A. This cost is estimated to be $10,000.00. Upon receipt of a bill make payment to the Service for the City's share of the cost of the works improvement. Payment must be received within 30 calendar days from the date of the bill, otherwise, it will be considered a late payment. For such late payments, interest will be accrued on the unpaid amount at a percentage rate based on the current value of funds to the U.S. Treasury for each 30 day period or portion thereof that the payment is delayed. Payments made by wire will be accepted and credited on the date received by the designated collection officer. 2. Accept all financial and other responsibility for excess. costs resulting from their failure to obtain, or their delay in obtaining adequate land and water rights, permits and licenses needed for the engineering services described in A. 3. Designate an individual to serve as liaison between the City and the Service with authority and Fesponsibility for reviewing and approving changes in the work described in A. Furnish such informa- tion in writing to the State Administrative Officer.
