DWELLINGS IN THE PLANNING UNITS 1, 2, 3, 4, #'J AND 17, DECLARING A SIXTY-FIVE (65) DAY GENEDA!U BUILDING MOAATORIUM 00 ALL MULTI-F~ILY PROi~ ~ OF TWENTY UNITS OR MORE',LIMITING BUILDING PE ... is ~ FOR MULTI-FAMILY CONSTRUCTION, DECLARING A S ~- ~ FIVE (65) DAY BUILDING MORATORIUM ON ALL PAR~~ OF LAND NOT ZONED IN CONFORMANCE WITH THE CI ~ MASTER PLAN, PROVIDING FOR THE REVOCATION OF CER- TAIN BUILDING PERMITS, SUSPENDING THE BUILDING AND SITE DEVELOPMENT PERMIT PROCESS, DIRECTING THE CITY MANAGER TO PREPARE A REPORT BY JUNE 4, 1984, REGULATING DENSITY OF RESIDENTIAL CONSTRUC- TION, DECLARING AN EMERGENCY AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Council of the City of San Marcos has determined that wastewater capacity in the Chestnut/No L.B.J./ Sessom area is becoming overloaded because of the level of de- velopment in the area and drainage infiltration of the main sewer line; and, WHEREAS, the City Council of the City of San Marcos has determined that traffic congestion is excessive in the Chest- nut/No L.B.J./Sessom area; and, WHEREAS, the City Council of the City of San Marcos has determined that water pressures in certain parts of the Chest- nut/No L.B.J./Sessom area are inadequate; and, WHEREAS, the City Council of the City of San Marcos has determined that it is necessary to maintain the status quo in the Chestnut/No L.B.J./Sessom area while additional information is secured by staff for consideration by Council concerning the above-mentioned problems in the Chestnut/No L.B.J./Sessom area; and, WHEREAS, the City Council of the City of San Marcos has determined that the level of recent growth in the City neces- sitates more rapid implementation of the City of San Marcos Master Plan; and, WHEREAS, the City Council of the City of San Marcos has found that numerous parcels of land throughout the City are presently zoned out of compliance with the Master Plan Land Use Element; and, WHEREAS, the City Council of the City of San Marcos finds that it is necessary to preserve the status quo to prevent further development in the City that is not in compliance with the Master Plan until such time as more progress has been made to further implement the Master Plan; and, WHEREAS, the City Council of the City of San Marcos has determined that rapid growth in the City, particularly in multi-family development, has made it necessary to review the adequacy of the Land Use Element of the City's Master Plan; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That for a period of sixty-five (65) days from the effective date hereof no building permits for other than single-family residential construction be issued in Planning Units 1, 2, 3, 4, 10, and 17 as they are designated in the City's Master Plan.
