<br /> ADDENDUM TO LEASE N~D OPERATING AGREEMENT <br /> Under the terms of this lease, NAAC will be allowed to fuel its <br /> own and its customers' aircraft. It is not the intent of NAAC <br /> to become or act as a Fixed Base Operator. NAAC agrees to comply <br /> dith safe fueling standards established by the Federal Aviation <br /> AdDinistration and the City of San Marcos. NAAC further agrees <br /> that should it be found servicing or selling fuel to other than <br /> NAAC-owned or operated aircraft or aircraft that are being in- <br /> stalled, maintained, or serviced, with NAACmanufactured goods, <br /> it will pay a $500 penalty as liquidated damages per occurrence. <br /> For the purpose of enforcing this provision, the airport manager or <br /> his/her designee may perform periodic unannounced inspections. If NAAC <br /> disputes the findings of the airport manager or his/her designee, the <br /> issue will be brought before the airport commission, pursuant to the <br /> Code of Ordinances, City of San Marcos, Sectio-'l 31.5, Appeal Hearing <br /> 50ard. <br />
