<br /> -6- <br />Sec. 11. certificate procedure: notice; reasonSi <br /> appeal. <br />(a) Prior to issuance or denial of a certificate <br /> of appropriateness the Commission shall take <br /> such action as may reasonably be required to <br /> inform the owner or person in charge of any <br /> property likely to be materially affected by <br /> the application, and shall give the applicant <br /> and such owner an opportunity to be heard. <br />(b) In cases where the Commission deems it <br /> necessary, it may hold a public hearing <br /> concerning the application. <br />(c) If the Commission determines that the <br /> proposed construction, reconstruction, <br /> alteration, moving or demolition is <br /> appropriate, it shall forthwith approve such <br /> application and shall issue to the applicant <br /> a certificate of appropriateness. <br />(d) If the Commission determines that a <br /> certificate of appropriateness should not be <br /> issued, it shall place upon its records the <br /> reasons for such determination and shall <br /> forthwith notify the applicant of such <br /> determination, furnishing him/her an attested <br /> copy of its reasons therefor and its <br /> recommendations, if any, as appearing in the <br /> records of the Commission. <br />(e) The Commission may approve such application <br /> in any case where the owner would suffer <br /> extreme hardship, not including loss of <br /> profit, unless the certificate of <br /> appropriateness were issued forthwith. <br />( f) Any applicant or interested person aggrieved <br /> by a ruling of the Commission under the <br /> provisions of this section may, within thirty <br /> (30) days after the ruling, appeal to the <br /> Zoning Board of Adjustments and Appeals in <br /> written form. <br />Sec. 12. Ordinary maintenance allowed; public <br /> safety. <br />(a) Nothing herein shall be construed to prevent <br /> the ordinary maintenance or repair of any <br /> exterior feature in an historic district or <br /> of any landmark which does not involve a <br /> change in design, material, color, or outer <br /> appearance thereof. <br />(b) Nothing herein shall prevent the <br /> construction, reconstruction, alteration, <br /> restoration or demolition of any such feature <br /> which the building inspector or similar <br /> official shall certify is required for the <br /> public safety because of an unsafe or <br /> dangerous condition. <br />Sec. 13. Acquisition of historic easements. <br />The city may acquire, by purchase, donation or <br />condemnation, historic easements ln any area <br />within its jurisdiction wherever and to the <br />extent that the City Council, upon the <br />recommendation of the Commission, determines <br />
