<br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
<br /> SAN MARCOS, TEXAS, APPROVING THE PRICE AND CON-
<br /> DITIONS OF THE SALE BY THE CITY OF SAN MARCOS,
<br /> TEXAS, OF LOTS NINE ( 9) AND TEN (10) IN BLOCK
<br /> TWENTY-SIX (26), VICTORY GARDENS, SECTION TWO
<br /> (2), A SUBDIVISION LOCATED IN SAID CITY, TO
<br /> BILL BOYD; AUTHORIZING THE MAYOR TO EXECUTE A
<br /> WARRANTY DEED TO BILL BOYD AND DECLARING AN
<br /> EFFECTIVE DATE.
<br /> WHEREAS, the City of San Marcos, Texas, advertised for bids
<br />for the sale of Lots Nine ( 9) and Ten (10) in Block Twenty-six
<br />(26), Victory Gardens, Section Two (2), a subdivision in the City
<br />of San Marcos, Hays County, Texas, according to the map or plat
<br />thereof, recorded in Volume 130, Pages 48-52 of the Deed Records
<br />of Hays County, Texas, also known as Urban Renewal Parcel No. 40R-4
<br />in the San Marcos Record, a local newspaper with a general circulation
<br />in the County of Hays, State of Texas, on March 25, 1984 and March
<br />27, 1984; and,
<br /> WHEREAS, pursuant to said advertisement a bid was submitted
<br />by Bill Boyd for said described property in the amount of five
<br />thousand one hundred dollars ($5,100.00); and,
<br /> WHEREAS, said bid met the minimum disposition price set for
<br />said property by the Urban Renewal Board of Commissioners of the
<br />City of San Marcos, Texas on September 8, 1983; and,
<br /> WHEREAS, said Board accepted the bid as the highest and best
<br />responsible bid for said property on April 4, 1984; and,
<br /> WHEREAS, said Board recommends the approval of said purchase
<br />price and the approval of the terms and conditions for said sale,
<br />as contained in the bid document; now, therefore,
<br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS,
<br />TEXAS:
<br /> SECTION 1. That the terms and conditions of the sale by the
<br />City of San Marcos, Texas, of Lots Nine (9) and Ten (10) in Block
<br />Twenty-Six (26), Victory Gardens Section Two (2), a subdivision
<br />in the City of San Marcos, Hays County, Texas, according to the map
<br />or plat thereof, recorded in Volume 130, Pages 48-52 of the Deed
<br />Records of Hays County, Texas, also known as Urban Renewal Parcel
<br />No. 40R-4, to Bill Boyd are hereby approved.
<br /> SECTION 2. That the consideration of five thousand one
<br />hundred dollars ($5,100.00) for said property be, and the same is
<br />hereby, approved.
<br /> SECTION 3. That the purchaser is hereby placed on notice that
<br />the subject property is subject to assessment under the provisions
<br />of Article 1105b, Texas Revised civil Statutes.
<br /> SECTION 4. That the Mayor of the City of San Marcos, Texas,
<br />Emmie Craddock, be, and is hereby, authorized to execute a warranty
<br />deed to Bill Boyd from the City of San Marcos for said property.
<br /> SECTION 5. That this Ordinance shall be in effect ten days
<br />from and after its passage and after its publication in a newspaper
<br />of general circulation in the area.
