Standard Agreement to Contribute <br />State Performs Work <br />Attachment C <br />Description <br />The Local Government has coordinated certain utility adjustments solely at their <br />cost. The Local Government shall be allowed a credit towards the Local <br />Government's overall participation of the actual dollar amounts spent on eligible <br />utility adjustments to the extent such amounts exceed the Local Government's <br />required 10% contribution towards reimbursable utility adjustments. All expenses <br />incurred by the Local Government towards reimbursable utility adjustments are <br />subject to review and approval by TxDOT's Right of Way Division prior to any <br />offset towards the Local Government's 10% contribution requirement. Under no <br />circumstance will the Local Government's expenditures towards reimbursable <br />utility adjustment create an obligation by the State to refund the Local <br />Government over and above the State's 90% participation requirements such <br />that the Local Government's contribution to the project is less than 10 %. <br />This is an estimate.
