128 Regular Meeting February 25,1985 Page 11 Mr. Brown moved the Council adjourn into Executive Session pursuant to Article 6252-17, §2(e), V.A.C.S., to seek the City Attorney's ad- vice with respect to pending litigation (Stokes vs. City) and matters where the duties of the City Attorney to the City pursuant to the Code of Professional Responsibility of the State Bar of Texas clearly con- flicts with Article 6252-17 (negotiation of contracts). Mr. Guerra seconded the motion, ~hich passed unanimously (11:02 p.m.). Ms. Kissler moved the Council convene and Mr. Coddington seconded the motion, which passed unanimously (11:47 p.m.). Mr. Farr moved Item 15A be removed from the table, and Mayor Craddock seconded the motion, which passed unanimously. Mayor Craddock then introduced Item 15A, adoption of a Resolution, the caption which was read as follows: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS APPROVING THE TERMS AND CONDITIONS OF A PROPOSED ADDENDUM TO THAT INTERLOCAL AGREEMENT BE- TWEEN THE CITY OF SAN MARCOS, TEXAS AND HAYS COUNTY, TEXAS ENTERED INTO AS OF OCTOBER 15, 1984, TO PROVIDE FOR VARIANCES TO CERTAIN PLATTING, ZONING, BUILDING AND SITE-DEVELOPMENT PROCEDURES BUT NOT PROVIDING FOR VARIANCES TO ANY SUBSTANTIVE REQUIREMENTS OF SAID RULES AND REGULATIONS; AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT ON BEHALF OF SAID CITY AND DECLARING AN EF- FECTIVE DATE. Mr. Farr moved to table the matter until further action of the Mayor and Mr. Coddington seconded the motion, which passed unanimously. Mayor Craddock moved Item 15F be removed from the table, and Mr. Farr seconded the motion, which passed unanimously. Mayor Craddock then introduced Item 15F, adoption of a Resolution, the caption which was read as follows: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING THE TERMS AND CONDITIONS OF AN AGREEMENT WITH SOUTHWEST TEXAS STATE UNIVERSITY FOR THE PROPOSED SALE BY SAID CITY OF PROPERTY LOCATED ADJACENT TO COMANCHE STREET; AUTHORIZING THE CITY MAN- AGER OF SAID CITY TO EXECUTE SAID AGREEMENT AND DECLAR- ING AN EFFECTIVE DATE. Mr. Brown moved for adoption of the Resolution and Mr. Coddington se- conded the motion. On roll call the following vote was recorded: AYE: Brown, Coddington, Craddock, Kissler, Moore. NAY: None. ABSTAIN: Farr, Guerra. Mayor Craddock introduced for consideration adoption of a Resolution, the caption which was read as follows: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS AUTHORIZING AND APPROVING THE TERMS AND CONDITIONS OF A PROPOSED AGREEMENT BETWEEN MELISSA MILLECAM AND SAID CITY FOR THE PROVISION OF PUBLIC IN- FORMATION SERVICES; AUTHORIZING THE CITY MANAGER TO EXECUTE SAID AGREEMENT; AND DECLARING AN EFFECTIVE DATE.
