<br /> 39 <br /> STATE OF TEXAS <br /> AGREEMENT REGARDING WATER AND <br /> WASTEWATER IMPROVEMENTS <br /> COUNTY OF HAYS <br /> KNOW ALL PERSONS BY THESE PRESENTS: <br /> That this Agreement is made and entered into on this 6th <br /> day of June, 1984, by and between the City of San Marcos, a <br /> municipal corporation organized under the laws of the State <br /> of Texas (hereinafter referred to as "City") and JWB <br /> Development, Inc., (hereinafter referred to as "JWB"), the <br /> developer of the Baunach Subdivision, for the purposes and <br /> considerations hereinafter described: <br /> Whereas, the Subdivision Ordinance of the City of San <br /> Marcos, Ordinance No. 1980-41, provides for the installation <br /> of certain public improvements, including an allocation of <br /> the cost of such improvements¡ <br /> Whereas, the City desires to have certain wastewater <br /> lines to be constructed by JWB oversized in accordance with <br /> Article 7, Subdivision Ordinance of the City of San Marcos <br /> and with the City's Master Plan¡ <br /> Whereas, JWB is willing to participate with the City in <br /> the construction of such lines¡ <br /> Whereas, the City, through its Public Works Department, <br /> has required the construction of sewer lines of a size <br /> greater than is required to adequately serve the Baunach <br /> Subdivision, the plat of which is attached hreto as Exhibit <br /> "A"; <br /> Whereas, JWB has previously paid for 116 living unit <br /> equivalents of water and wastewater capacity for service to <br /> the Banauch Subdivision; <br /> Now, therefore, the City and JWB, in consideration of <br /> the mutual promises, covenants and agreements set forth <br /> herein expressly agree and contract as follows: <br />
