<br /> 66 <br /> ORDINANCE 1984-70 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br /> OF SAN MARCOS, TEXAS, DECLARING A BUILDING <br /> MORATORIUM FOR MULTI-FAMILY DWELLINGS IN <br /> PLANNING UNITS 1, 2, 3, 4, 5, 52, 53, 18 <br /> AND 32; LIMITING THE NUMBER OF L.U.E.'S <br /> ISSUED FROM REMAINING SEWERAGE TREATMENT <br /> CAPACITY; REQUIRING COMPLIANCE WITH THE MASTER <br /> PLAN LAND USE ELEMENT; ESTABLISHING A CITIZEN <br /> COMMITTEE TO ADVISE COUNCIL ON PROBLEM SOLU- <br /> TIONS; DECLARING AN EMERGENCY AND PROVIDING <br /> FOR AN EFFECTIVE DATE. <br /> WHEREAS, the City Council of the City of San Marcos <br />has received a detailed report from its City Manager con- <br />cerning problems with public improvements throughout the <br />City; and, <br /> WHEREAS, the City Council of the City of San Marcos <br />has accepted the City Manager's report and attached it to <br />this Ordinance for all intents and purposes; and, <br /> WHEREAS, the City Council of the City of San Marcos <br />has determined that serious problems with inadequate pub- <br />lic improvements and facilities exist within the City <br />limits of the City of San Marcos as outlined in the City <br />Manager's report; now, therefore, <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS: <br /> SECTION 1. That from the effective date of this Ordi- <br />nance and until further action by the City Council, no <br />building permits for other than single-family residential <br />construction be issued in planning units 1, 2, 3, 4, 5, <br />52, 53, 18 and 32 as they are designated in the City's <br />""Master Plan, except that any rehabilitation, remodelling, <br />or construction buildouts under existing building shells <br />shall be permitted in each of the planning units designated <br />above. <br /> SECTION 2. That from the remaining sewerage treatment <br />capacity now available to the City, no more than 5 L.U.E. 's <br />may be issued per building permit and per builder, developer, <br />partnership, construction company, any similar entity or <br />anyone working in consort with such an entity until such <br />time as all available existing sewerage capacity is allo- <br />cated. All requests for more than 5 L.U.E.'s as noted <br />above shall be satisfied from new capacity to be derived <br />from a package sewerage treatment plant to be built at <br />some future date after the City has received letters of <br />credit from interested parties sufficient to cover the <br />cost of such a package plant. <br /> SECTION 3. That from and after the effective date <br />hereof, no building permits or site development permits <br />be issued for any type of construction on any parcel of <br />land within the City of San Marcos that is zoned for a <br />use not in compliance with the land use element of the <br />Master Plan of the City of San Marcos, Ordinance 1983- <br />22, which was passed, approved and adopted on May 9, 1983. <br /> SECTION 4. Tha t a nine-member citizen a,dvisory conmittee is <br />hereby established of a compositiOÏì to be de- <br />termined by Council to advise Council on solutions to <br />problems discussed in the City Manager's report which <br />is attached hereto and made a part hereof for all in- <br />tents and purposes. Said citizen advisory committee <br />shall serve at the pleasure and direction of Council <br />until it is dissolved by action of the Council. <br />
