DRAFT AGREEMENT Page 3 the event annexation is not completed, then continuing until date of annexation its right to all revenues from existing customers on the Maxwell water utility system which are to become a part of said system to be annexed by the City. 5. Provide Maxwell with three (3) year written notifi- cation of City's intent to annex portions of the certi- fied water service area of the Maxwell Water System. 6. Provide maintenance of all Maxwell lines to be transferred to the city ownership within the effected notice period, subject to a perfomance standard to be established, and perform such maintenance utilizing either the City's force or Maxwell's (in which latter case Maxwell would be compensated for direct cost incurred. ) ( Suggested performance standards: leaks on lines greater than or equal to 3"diameter will be required within four (4) hours.) 7. Remove from City tax rolls all property to be acquired by city from Maxwell following annexation. 8. To exem ': Maxwell from having to obtain licenses or permits to service customers in the annexed area. 9. Exempt Maxwell from City Tax Rolls on property acquired. 10. Pay Maxwell for the right to use areas that are within the Maxwell certified service area. 11. Negotiate with developers to apy for overages required by the city (Overage is defined as that size of pipe, valves, hydrants and other system improvements used to meet City's long-term needs in accordance with City's specifications and Master Plan requirements in excess of the size of pipe, valves, hydrants, and other system imrpovements which would have been used to meet the developer's and Maxwell's long term need in accordance with sould engineering practices.)
