<br />DRAFT AGREEMENT Page 3 <br /> the event annexation is not completed, then continuing <br /> until date of annexation its right to all revenues from <br /> existing customers on the Maxwell water utility system <br /> which are to become a part of said system to be annexed <br /> by the City. <br />5. Provide Maxwell with three (3) year written notifi- <br /> cation of City's intent to annex portions of the certi- <br /> fied water service area of the Maxwell Water System. <br />6. Provide maintenance of all Maxwell lines to be <br /> transferred to the city ownership within the effected <br /> notice period, subject to a perfomance standard to be <br /> established, and perform such maintenance utilizing <br /> either the City's force or Maxwell's (in which latter <br /> case Maxwell would be compensated for direct cost <br /> incurred. ) ( Suggested performance standards: leaks on <br /> lines greater than or equal to 3"diameter will be <br /> required within four (4) hours.) <br />7. Remove from City tax rolls all property to be acquired <br /> by city from Maxwell following annexation. <br />8. To exem ': Maxwell from having to obtain licenses or <br /> permits to service customers in the annexed area. <br />9. Exempt Maxwell from City Tax Rolls on property <br /> acquired. <br />10. Pay Maxwell for the right to use areas that are within <br /> the Maxwell certified service area. <br />11. Negotiate with developers to apy for overages required <br /> by the city (Overage is defined as that size of pipe, <br /> valves, hydrants and other system improvements used to <br /> meet City's long-term needs in accordance with City's <br /> specifications and Master Plan requirements in excess <br /> of the size of pipe, valves, hydrants, and other system <br /> imrpovements which would have been used to meet the <br /> developer's and Maxwell's long term need in accordance <br /> with sould engineering practices.) <br />
