ATTACHMENT "A", Page 54 § 10.41 FIRE PREVENTION AND PROTECTION § 10.42 Sec. lOon. Amendments. [The fire prevention code adopted in section 10-38 is hereby amended in the fol1owing respects:] Section 16.75. A subsection shall be added to section 16.75, Dispensing Systems, as fo11ows: 16.75c Dispensing Units (5). i. No tank vehicles shall be used for the retail sale of flammable or combustible liquids to motor vehicles, ex- cept that this provision shall not apply to the sale of such liquids to aircraft at an airport or to construction machinery at the construction site. (Ord. of 8-9-71, § 9) Sec. 10-,42. Establishment and .-"ties of bureau of fire pre- yen tion. (a) The fire prevention code shall be enforced by the bureau of fire prevention in the fire department of the City of San Marcos which is hereby established and which shaH be operated under the supervision of the chief of the fire department. (b) The fire marshal in charge of the bureau of fire pre- vention shaH be appointed by the city manager on the basis of examination to determine his qualifications. His appoint- ment shall continue during good behavior and satisfactory service, and he sha11 not be removed from office except for cause after public trial. (c) The chief of the fire department may detail such mem- bers of the fire department as inspectors as sha11 from time to time be necessary. The chief of the fire department sha11 recommend to the city manag;er the employment of technical inspectors, who, when such authorization is made, shall be se1ected through an examination to determine their fitness for the position, The examination shaJl be open to members and nonrnemlwrs of the fire department, and appointments made after examination shall be for an indefinite term with 1'emo\'"l only for cause.
