<br /> subcontracts financed in whole or in part with Federal funds provided <br /> under this agreement. In this regard, all contractors shall take all <br /> necessary and reasonable steps in accordance with 49 CFR Part 23 to <br /> ensure that minority business enterprises have the maximum opportunity <br /> to compete for and perform contracts. CONSULTANTS shall not discrim- <br /> inate on the basis of race, color, national origin, sex, age, or <br /> physical handicap in the award and performance of DOT-assisted con- <br /> tracts. <br /> ARTI ClE 12 <br /> ACCESS TO RECORDS <br /> 12.1 The OWNER, the Federal Aviation Administration, the Comptrol- <br /> ler Gene ra 1 of the United States, or any of their duly authorized <br /> representatives, shall have access to any books, documents, papers and <br /> records of the Engineer which are directly pertinent to this project <br /> for the purpose of making audit, examination, excerpts, and transcrip- <br /> tions. <br /> ARTICLE 13 <br /> TERMINATION OF CONTRACT <br /> 13.1 In connection with all the work outlined or contemplated <br /> above, it is agreed that the OWNER or the CONSULTANT may cancel or <br /> terminate this contract upon thirty (30) days written notice to the <br /> other, with the provision and understanding that immediately upon <br /> receipt of notice of such cancellation from either party to the other, <br /> all work and labor being performed under this contract shall immedi- <br /> ately cease, pending final cancellation at the end of such thirty-day <br /> peri od, and further provided that the CONSULTANT shall be compensated <br /> for Costs Plus fixed fee representing the value of all work accom- <br /> plished by him prior to the receipt of notice of such termination. <br /> ARTICLE 14 <br /> VENUE <br /> 14.1 Venue and jurisdiction of any suit, or right to a cause of <br /> action arising under or in connection with this contract sha 11 lie <br /> exclusively in Hays County, Texas. <br />
