The building inspection official or his designated representative shall not issue a Plumbing Permit until the payment of the CRFN charged hereunder is made. All CRFN paid to the building inspection official or a designated representative shall be deposited into the special account created and maintained under Section 30-49 hereof. Section 30-47. CRFN Derivation and Appeal 1. When in the determination of the Public Works Director or his designated representatives, a new Structurer Remodeling or Addition is not included within any category of uses set out in Section 30-45r prior to issuance of -the Plumbing Permit the Director of Public Works or his designated representative shall derive the Living Unit Equivalent for the proposed use. Said derivation shall be made utilizing the average daily water consumption of similar structures and/or uses for the previous 12-month period. If a similar use and/or structure does not exist at the time of request for a Pl umbing Permit the Living Uni-t Equivalent shall be derived as in Section 30-48 of this Ordinance. 2. An applicant may pay under protest the CRFN charged by the Director of Public Works and appeal such charge as provided in this subsection. Upon payment of the CRFN under protest, the Plumbing Permit shall be issued as if no appeal were taken. If upon final hearing and determination of the appealed matter by the Council it is found that the party overpaid, the party will be refunded the amount overpaid. If the party underpaid the CRFNr any deficiency will be due to the City 10 days after final determination and notice of the amount of deficiency. No final occupancy permit otherwise known as a certificate of occupancy shall be issued until payment of such deficiency. 3. An applicant for Plumbing Permit or the owner of the property or such party's representative has the right to appeal to the City Councilr by delivery of written notice duly verified and submitted at least five (5) working days before next Council meeting to the City Secretary the CRFNr if the grounds for such appeal are based on: ( a) the use designation of the Structure pursuant to Section 30-44; and/or (b) the numerical considerations or determinations of the LUE Factors used in computing the CRFN pursuant to Section 30-45 or Section 30-47.
