<br /> -9- <br /> ( 2) the charge will be based on an <br /> estimate of anticipated water usage <br /> derived by the Director of Public <br /> Works using available information at <br /> his disposal; <br /> ( 3) after a l2-month period has expired, <br /> a revised CRFEC bill will be derived <br /> based on the formula speci fied ln (d) <br /> of this section; and, <br /> ( 4) if the customer overpaid, such party <br /> will be refunded the amount overpaid. <br /> If the customer underpaid, any <br /> deficiency will be due to the City 10 <br /> days after final determination and <br /> notice of the amount of deficiency; <br /> ( f) This fee will be charged to the customer <br /> on the customer's utility bill as <br /> provided in Chapter 30, Division 3, <br /> Section 30-34, et seq. <br /> 2. Any party assessed this fee may petition for <br /> adjustment as provided in Section 30-47 under <br /> this chapter. <br /> Section 30-49. Prepayment of CRF for Advanced <br /> Commitments on Water <br /> Distribution System <br /> When a party wishes to secure from the City of <br /> San Marcos an advance commitment to reserve water <br /> production capacity for any use, the party may do <br /> so provided that the following conditions are <br /> met; <br /> a) The CRF be paid in advance at the rate of <br /> $1,100 per living unit equivalent; <br /> b) The commitment given to the party who <br /> seeks the said capacity will not be <br /> transferable (other than as provided <br /> below) and will be in effect for a period <br /> not to exceed six (6) years from the date <br /> of the signing of the reserva"tion by the <br /> Mayor of the City; <br /> c) Before the commitment is granted to the <br /> party who seeks "the said capacity, a <br /> determination will be made by the Public <br /> ~'i1orks Director that the capacity being <br /> requested is either capacity which is <br /> available by existing well sites as of the <br /> effective date of this Ordinance or the <br /> capacity being requested is capacity being <br /> developed as evidenced by the sale of <br /> appropriate obligations by the City for <br /> necessary water system improvements, or <br /> the capacity being requested is capaci "ty <br /> available because of newly constructed <br /> water system facility improvements. This <br /> determination will be forwarded to City <br /> Council along with a description of the <br /> property where the reservation will be <br /> used and other appropriate information; <br />
