<br /> progresses, by interpretation of the plans, specifications and other <br /> contract documents to and with the Contractor(s), by the disapproval <br /> of defective work and the issuance of stop-orders from the Owner <br /> with respect to defective procedures, where they are observed, and <br /> the Engineer will exercise due diligence to assist the Owner in requiring <br /> that the work be done in accordance with plans and specifications; <br /> but the Contractor will remain independent contractors with the Owner, <br /> and the Engineer does not guarantee the performance of such construction <br /> contracts. <br /> 9. Special Consultants: When and to the extent required to <br /> perform services under this agreement outside the normal range and <br /> scope of engineering services by the use of special consultants in <br /> other professional fields, such as lawyers, accountants, archaeologists, <br /> ornithologists, soil analysis, boundary surveys, rate experts, and <br /> similar types of other professional skills. The Engineer shall be <br /> reimbursed the cost of such consulting services plus an allowance <br /> of ten percent of such costs to compensate the Engineer for arranging, <br /> administering and coordinating the work and reports of such outside <br /> consultants. The special consulting services shall require the written <br /> authorization of the Owner. These fees are not a part of the compensa- <br /> tion presented in Paragraph 3. <br /> 10. Ownership of Documents: Drawings and specifications as <br /> instruments of service are the property of the Engineer whether the <br /> work on which they are made be executed or not and the Engineer will <br /> retain in his files original drawings and specifications for the <br /> work. The Engineer will provide twenty-five sets of plans and speci- <br /> fications and bid documents. Additional sets of plans and specifi- <br /> cations and bid documents as are necessary in the receiving of bids <br /> for construction and as are required in the execution of the Project <br /> will be furnished at actual cost (defined as prevailing commercial <br /> printing rate). Upon completion of construction, the Engineer shall <br /> revise the working drawings in accordance with data furnished by <br /> Contractor(s) to show the Project as constructed and the Owner shall <br /> be furnished two sets of prints and one set of reproducibles made <br /> from the "Record" drawings. <br /> 11. Termination of Contract: This Contract may be terminated, <br /> or the scope of work may hereunder be modified at any time without <br /> penalty or liability except as may otherwise be specified herein, <br /> provided the Engineer will be entitled to compensation for work com- <br /> pleted prior to such termination. <br /> 7. <br />
