<br />87 <br /> <br /> <br />ORDINANCE 1984-82 <br /> <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS, AMENDING <br />ORDINANCE NO. 1984-44 ADOPTED APRIL 9, <br />1984 ESTABLISHING A USER FEE IN THE <br />NATURE OF A LICENSING TAX IN THE AMOUNT <br />OF SIX HUNDRED DOLLARS ($600.00) PER <br />MONTH FOR THE USE OF STREETS AND HIGHWAYS <br />IN SAID CITY BY TRANSPORTATION ENTERPRISES, <br />INCORPORATED FOR THE MAINTENANCE AND <br />OPERATION OF ITS SHUTTLE BUS SERVICE ON <br />AND OVER SAID STREETS AND HIGHWAYS, TO <br />RENUMBER SECTION 5 TO SECTION 6; TO <br />ADD A NEW SECTION 5 TO PROVIDE FOR <br />APPLICABILITY OF SAID ORDINANCE TO AND <br />ENFORCEABILITY OF SAID ORDINANCE AGAINST <br />ALL SUCCESSORS AND ASSIGNS OF TRANSPORTA- <br />TION ENTERPRISES, INCORPORATED, AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br /> <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS: <br /> <br />SECTION 1. That Section 5 of Ordinance No. 1984-44 <br />adopted April 9, 1984 is hereby renumbered to and shall <br />henceforth be, Section 6. <br /> <br />SECTION 2. That Ordinance No. 1984-44 adopted April <br />9, 1984 is hereby amended to add a section to be numbered <br />Section 5 which shall read as follows: <br /> <br /> <br />. . . <br /> <br /> <br />SECTION 5. That this ordinance shall be <br />applicable to, in full force and effect and enforceable <br />against any and all successors and assigns of <br />Transportation Enterprises, Incorporated. <br /> <br /> <br />. . . <br /> <br /> <br />SECTION 3. That the importance of this Ordinance <br />creates an emergency and an imperative public necessity so <br />that the provisions of the charter requiring that ordinances <br />be presented at three separate meetings and that no ordinance <br />shall become effective until the expiration of ten (10) days <br />following the date of its final passage be suspended and <br />these provisions are hereby suspended, and this Ordinance <br />shall take effect and be in full force and effect from and <br />after its adoption and after its publication in a newspaper <br />of general circulation within the City. <br /> <br />PASSED, APPROVED AND ADOPTED this 27 day of August, <br />1984. <br /> <br /> <br />~(£ <br /> <br />Emmie Craddock <br />Mayor <br /> <br />Attest: <br /> <br /> <br /> <br /> <br />s K.
