<br /> 63 <br /> THE STATE OF TEXAS X <br /> X <br /> COUNTY OF HAYS X <br /> INTERLOCAL AGREEMENT BETWEEN <br /> THE CITY OF SAN MARCOS, TEXAS AND <br /> THE SAN Jv1ARCOS CONSOLIDATED INDEPENDENT SCHOOL DISTRICT <br /> THIS INTERLOCAL AGREEMENT (this "Agreement") dated as of <br /> October 15 , 1984 between the City of San Marcos, Texas, <br /> a municipal corporation duly incorporated under the Constitu- <br /> tion and laws of the State of Texas (the "City"), acting by <br /> and through its City Council (the "City Council"), and the <br /> San Marcos Consolidated Independent School District, a duly <br /> authorized school district of the State of Texas (the "School <br /> District"), acting by and through its Board of Trustees (the <br /> "School Board"), <br /> WITNESSETH: <br /> ~\THE REAS, pursuant to the Interlocal Cooperation Act, <br /> Article 4413 (32c), Vernon's Texas Civil Statutes, as amended <br /> (the "Ac t " ), cities and school districts of the State of Texas <br /> are authorized to enter into intergovernmental contracts re arCln <br /> governmental functions and serVlces as further set forth In the <br /> l\ct; <br /> ìriíHEREAS, the School District expects to undertake the lSSU- <br /> ance of bonds, certificates of obligation, or other form of <br /> indebtedness of the School District to provide funds for schoc <br /> building expansion; <br /> ì\THE REAS, the City and the School District have determined <br /> to enter into this Agreement in order that the School District <br />
