<br /> 68 <br /> RESOLUTION 1984-94R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br /> SAN MARCOS, TEXAS APPROVING FINAL PAYMENT TO <br /> TED BREIHAN ELECTRIC COMPANY FOR THE FURNISHING <br /> AND INSTALLATION OF A TRAFFIC SIGNAL AT THE IN- <br /> TERSECTION OF LOOP 82 AND BUGG LANE IN SAID CITY; <br /> ACCEPTING SAID TRAFFIC SIGNAL FOR USE BY SAID <br /> CITY; AUTHORIZING FINAL PAYMENT IN THE AMOUNT <br /> OF $8,362.50 AND DECLARING AN EFFECTIVE DATE. <br /> WHE REAS, the City of San Marcos, Texas has engaged the <br /> services of Ted Breihan, d/b/a Ted Breihan Electric Company <br /> for the furnishing and installation of a traffic signal at <br /> the intersection of Loop 82 and Bugg Lane ln said City; and, <br /> WHEREAS, said services were provided pursuant to a con- <br /> tract between the City of San Marcos, Texas and Ted Breihan, <br /> d/b/a Ted Breihan Electric Company, entered into on January 13, <br /> 1984; and, <br /> WHEREAS, on August 15, 1984, Wayne T. Henderson, Public <br /> Works Inspector and Bill McCauley, Public Works Superintendent, <br /> for the City of San Marcos, Texas, and Ted Breihan conducted <br /> a final inspection and found the furnishing and installation <br /> of said traffic signal to have been completed in substantial <br /> compliance with the terms and conditions of said contract <br /> of January 13, 1984 between said parties; now, therefore, <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS: <br /> PART 1. That the furnishing and installation of a traffic <br /> signal at the intersection of Loop 82 and Bugg Lane in said <br /> City has been completed in substantial compliance with that <br /> contract of January 13, 1984 between Ted Breihan, d/b/a Ted <br /> Breihan Electric Company and the City of San Marcos, Texas, <br /> and said traffic signal is hereby accepted for use by said <br /> City. <br /> PART 2. That final payment in the amount of $8,362.50 <br /> to Ted Breihan Electric Company in full and final payment for <br /> such furnishing and installation of such traffic signal at <br /> the intersection of Loop 82 and Bugg Lane in said City is <br /> hereby authorized. <br /> PART 3.
