81 ORDINANCE 1984-98 0'\ --- ~ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING SEC- TIONS 12-8 (a) (1) and (a) (2) OF CHAPTER 12 OF THE CODE OF ORDINANCES OF SAID CITY TO INCREASE THE MONTHLY CHARGES FOR GARBAGE AND RUBBISH COLLECTION FROM RESIDENTIAL UNITS LOCATED IN SAID CITY FROM $5.00 TO $6.00; N~ENDING SECTION 12-8 OF SAID CHAPTER OF SAID CODE TO ADD A SECTION TO BE NUMBERED 12-8(e) PROVIDING THAT FUNDS RECEIVED FROM THE INCREASE IN SUCH MONTHLY COST BE DEPOSITED IN AN ESCROW OR RESERVE FUND ESTABLISHED FOR THE AC- QUISITION OF A LANDFILL SITE OR COMPARABLE FACILITY FOR SAID CITY AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of San Marcos, Texas, finds that increasing the monthly charge for gar- bage and rubbish collection from residential units lo- cated in said City from $5.00 to $6.00 for the genera- tion of revenue for the acquisition of a landfill site or comparable facility (e.g. resource recovery) is in the interest and welfare of the citizens of San Marcos; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That Sections 12-8 (a) (1) and (a) (2) of Chapter 12 of the Code of Ordinances of the City of San Marcos, Texas, are hereby amended to read as follows: Sec. 12-8. Garbage and rubbish collection charges by city for residential units. (a) ... (1) For the collection of garbage and rubbish at a single-family dwelling within a resi- dential unit, per month............$6.00 (2) For the collection of garbage and rubbish at a duplex, triplex or fourplex, per month, for each unit within said duplex, triplex or fourplex........................$6.00 . .. SECTION 2. That Section 12-8 of Chapter 12 of the Code of Ordinances of the City of San Marcos, Texas, lS hereby amended to add the following Section 12-8(e) which shall read as follows: Sec. 12-8. Garbage and rubbish collection charges by city for residential units. . . . (e) An escrow Or reserve fund shall be established by the Director of Finance. The funds deposited in such account are to be used for the planning and ac- quisition of a sanitary landfill site or comparable facility (e.g. resource recovery) which will be used by the city for disposal of garbage and rubbish. From each monthly charge, per unit, the Director of Finance shall cause to be deposited $1.00 in said escrow or reserve fund.
