<br /> 87 <br /> ORDINANCE 1984-99 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br /> OF SAN HARCOS, TEXAS AMENDING THAT ORDINANCE <br /> ADOPTED JUNE 13, 1984 DECLARING A BUILDING <br /> MORATORIUM FOR MULTI-FAMILY DWELLINGS IN <br /> PLANNING UNITS 1, 2, 3, 4, 5, 52, 53, 18 AND <br /> 32, LIMITING THE NUMBER OF L.U.E. IS ISSUED <br /> FROM REMAINING SEWERAGE TREATMENT CAPACITY, <br /> REQUIRING COMPLIANCE WITH THE MASTER PLAN <br /> LAND USE ELEMENT, AND ESTABLISHING A CITIZEN <br /> COMMITTEE TO ADVISE COUNCIL ON PROBLEM SOLU- <br /> TIONS TO EXCEPT FROM THE REQUIREI'1ENTS OF SUCH <br /> ORDINANCE BUILDERS OF SINGLE-FAMILY HOUSING <br /> AND THOSE NEEDING SEWAGE CAPACITY FOR CONSTRUC- <br /> TION BUILDOUTS UNDER EXISTING BUILDING SHELLS <br /> AND DECLARING AN EMERGENCY AND PROVIDING FOR <br /> AN EFFECTIVE DATE. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS: <br />SECTION 1. That Section 2 of Ordinance 1984-70 adopted <br />June 13, 1984 is hereby amended to insert the following <br />language at the end of the first sentence: <br /> ...except that builders of single-family housing <br /> and those needing sewage capacity for construction <br /> buildouts under existing building shells shall be <br /> exempt from this limitation. <br />SECTION 2. That the importance of this Ordinance creates <br />an emergency and an imperative public necessity so that the <br />provisions of the Charter requiring all ordinances to be pre- <br />sented at three (3) separate meetings and that no ordinance <br />shall become effective until the expiration of ten (10) days <br />following the date of its final passage, be suspended, and <br />this Ordinance shall take effect and be in full force and <br />effect from and after its adoption and after its publication <br />in a newspaper of general circulation within the City in ac- <br />cordance with the Charter of the City of San Marcos, Texas. <br />PASSED, APPROVED ~D AD~~iS 22 day of October , 1984. <br /> / -~ <br /> ( <br /> Emmie Craddock <br /> Mayor <br />Attest: <br />e:j~;)r~ <br />Janis K.
