87 ORDINANCE 1984-99 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN HARCOS, TEXAS AMENDING THAT ORDINANCE ADOPTED JUNE 13, 1984 DECLARING A BUILDING MORATORIUM FOR MULTI-FAMILY DWELLINGS IN PLANNING UNITS 1, 2, 3, 4, 5, 52, 53, 18 AND 32, LIMITING THE NUMBER OF L.U.E. IS ISSUED FROM REMAINING SEWERAGE TREATMENT CAPACITY, REQUIRING COMPLIANCE WITH THE MASTER PLAN LAND USE ELEMENT, AND ESTABLISHING A CITIZEN COMMITTEE TO ADVISE COUNCIL ON PROBLEM SOLU- TIONS TO EXCEPT FROM THE REQUIREI'1ENTS OF SUCH ORDINANCE BUILDERS OF SINGLE-FAMILY HOUSING AND THOSE NEEDING SEWAGE CAPACITY FOR CONSTRUC- TION BUILDOUTS UNDER EXISTING BUILDING SHELLS AND DECLARING AN EMERGENCY AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That Section 2 of Ordinance 1984-70 adopted June 13, 1984 is hereby amended to insert the following language at the end of the first sentence: ...except that builders of single-family housing and those needing sewage capacity for construction buildouts under existing building shells shall be exempt from this limitation. SECTION 2. That the importance of this Ordinance creates an emergency and an imperative public necessity so that the provisions of the Charter requiring all ordinances to be pre- sented at three (3) separate meetings and that no ordinance shall become effective until the expiration of ten (10) days following the date of its final passage, be suspended, and this Ordinance shall take effect and be in full force and effect from and after its adoption and after its publication in a newspaper of general circulation within the City in ac- cordance with the Charter of the City of San Marcos, Texas.
