RESOLUTION NO. 2014-38R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AUTHORIZING THE FILING OF A GRANT <br />APPLICATION WITH THE CAPITAL AREA COUNCIL OF <br />GOVERNMENTS FOR FY 2013 /2014 REGIONAL SOLID WASTE <br />PROGRAM GRANTS; PLEDGING THAT IF THE CITY RECEIVES <br />GRANT AWARDS IT WILL COMPLY WITH THE GRANT <br />REQUIREMENTS OF CAPCOG, THE TEXAS COMMISSION ON <br />ENVIRONMENTAL QUALITY AND THE STATE OF TEXAS; <br />AUTHORIZING THE CITY MANAGER TO ACT ON BEHALF OF THE <br />CITY IN ALL MATTERS RELATED TO THE GRANT APPLICATIONS <br />AND ANY SUBSEQUENT GRANT AGREEMENTS; AND DECLARING <br />AN EFFECTIVE DATE. <br />RECITALS: <br />1. The Capital Area Council of Governments ( "CAPCOG ") is directed by the Texas <br />Commission on Environmental Quality ( "TCEQ ") to administer solid waste grant funds for the <br />implementation of CAPCOG's adopted regional solid waste management plan <br />2. The City is qualified to apply for grand funds under the Request for Applications <br />process. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />PART 1. The filing of a grant application with CAPCOG through the FY 2013/2014 <br />Regional Solid Waste Grants Program in the amount of $10,000.00 for disposal services is <br />hereby approved. <br />PART 2. The City Manager is authorized to request grant funding under the <br />CAPCOG Request for Applications of the Regional Solid Waste Grants Program for the <br />household hazardous waste program and act on behalf of the City in all matters related to the <br />grant application and any subsequent grant contract and grant project that may result. <br />PART 3. If the projects are funded, the City will comply with the grant requirements <br />of CAPCOG, TCEQ, and the State of Texas. <br />PART 4. The grant funds will be used only for the purposes for which they are <br />intended under the grant. <br />PART 5. The City's activities regarding any projects resulting from these <br />applications will comply with and support the adopted regional and local solid waste <br />1 <br />
