<br /> 95 <br /> ORDINANCE 1984-100 <br /> AN ORDINANCE OF 'IHE CI'IY COUNCIL OF 'IHE CITY OF SAN <br /> MARCOS, TEXAS, DECLARING A MORA'IORIUM FOR 120 DAYS ON <br /> DEVEIDFMENTAL APPROVALS, INCWDI!'l; APPROVAL OF ZONI!'l; <br /> CHA!'JGES, PLATS, AND BJIIDING PERMITS, ON ALL LAND AREA <br /> LOCATED WI'IHIN 'IHE ONE HUNDRED (100) YEAR FLOOD PLAIN OF <br /> 'IHE SAN MARCOS RIVER FROM SPRI!'l; LAKE 10 'IRE CDNFWENCE <br /> OF 'IHE BLANCO AND SAN MARCOS RIVERS; D I RECTI!'l; 'IHE <br /> PREPARATION OF AN INTERIM CDMPREHENSIVE DEVEIDPMENT <br /> ORDINANCE, SAID ORDINANCE 10 BE DEVEIDPED IN ACCDRDANCE <br /> ~VI 'IH RESIDENTIAL DEVEIDPMENT OBJECTIVE 5 AND FOLICY 5-3 <br /> OF 'IHE LAND USE ELEMENT OF 'IHE SAN MARCOS MASTER PLAN, <br /> IN ORDER 10 PROTECT 'IRE ENVIRONMENTAL INTffiRI'IY OF 'IRE <br /> SAN MARCOS RIVER ECOSYSTEM FROM ADVERSE IMPACTS <br /> RE9JLTI!'l; FROM DEVEIDPMENT AND DECLARI!'l; AN EMERGENCY. <br /> WHEREAS, the City Council of the City of San Marcos, has received <br />a report from the Citizens Advisory Committee established by Ordinance <br />1984-70 detailing the environmental sensitivity of the San Marcos River <br />ecosystem; and, <br /> WHEREAS, the City Council of the City of San Marcos, Texas, has <br />determined that the enviroruœntal integrity of the San Marcos River <br />ecosystem will be adversely impacted from development if measures are <br />not taken immediately to protect it; now, therefore, <br />BE IT ORDAINED BY 'IHE CI'IY CDUNCIL OF 'IHE CI'IY OF SAN MARCOS, TEXAS: <br /> SECTION 1. That from and after the effective date of this <br />Ordinance no developmental approvals shall be made by said City, <br />including approval of zoning changes, plats, and building permits, on <br />any land area located within the one hundred (100) year flood plain of <br />the San Marcos River with all Soil Conservation Service dam projects <br />in place, as shown in the Watershed Plan and Ehviroruœntal Impact <br />Statemant, USDA-SCS-EIS-WS-(ADM)-78-2(F)-('IX), from Spring Lake to the <br />confluence of the Blanco and San Marcos Rivers, until the expiration of <br />one hundred and twenty (120) days after the effective date hereof or <br />after the adoption of an Interlin Comprehensive Development Ordinance, <br />whichever is sooner, the purpose of such ordinance being to protect <br />the enviroruœntal integrity of the San Marcos River ecosystem from <br />adverse impact resul ting from development in the above defined area. <br /> SECTION 2. That an Interlin Comprehensive Development Ordinance <br />shall be developed in accordance with Residential Development Objective <br />5 and Policy 5-3 of the Land Use Element of the San Marcos Master Plan. <br /> SECTION 3.
