<br />97 <br /> <br /> <br />ORDINANCE 1984-102 <br /> <br /> <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING SECTION 40(A) (1) OF <br />APPENDIX A OF THE CODE OF ORDINANCES OF SAID CITY <br />TO PROVIDE THAT ALL MEMBERS OF THE ZONING BOARD <br />OF ADJUSTMENTS SHALL RESIDE WITHIN THE CORPORATE <br />LIMITS OF SAID CITY AND THAT IN THE ABSENCE OF <br />REGULAR MEMBERS OF THE BOARD THE MAYOR, CITY <br />MANAGER OR THE PRESIDING OFFICER OF THE BOARD MAY <br />REQUEST THE ALTERNATE MEMBERS TO SERVE AND DE- <br />CLARING AN EFFECTIVE DATE. <br /> <br /> <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS: <br /> <br />SECTION 1. That Section 40(A) (1) of Appendix A of the <br />Code of Ordinances of the City of San Marcos, Texas is hereby <br />amended to read as follows: <br /> <br />Sec. 40. Board of adjustments, quorum, procedures <br />for appeals, and powers of the board. <br /> <br />A. Organization: <br /> <br />1. A zoning board of adjustments is hereby created <br />in accordance with the provisions of Article 1011g <br />of the Revised Civil Statutes of Texas. It shall <br />consist of five (5) regular members and two (2) <br />alternates who shall be appointed by the mayor with <br />approval by the city council of the City of San Mar- <br />cos, for a term of two (2) years, and removable for <br />cause by the city council upon written charges and <br />after public hearing. All such regular members <br />and alternates shall reside within the corporate limits <br />of the City of San Marcos. The alternate members shall <br />serve in the absence of one or more regular members <br />when requested to do so by the mayor, city manager <br />or presiding officer of the board, as the case may <br />be, so that all cases to be heard by the board of <br />adjustments will be heard by a minimum number of <br />four (4) members. Vacancies shall be filled for <br />the unexpired term of any member by appointment <br />by the city council. <br /> <br /> <br /> <br />SECTION 2.
