<br /> 101 <br /> RESOLUTION 1984-100R <br /> A REffiLUTION OF THE CITY COUNCI L OF THE CITY OF SAN <br /> MARCOS, TEXAS, AUTHORIZING THE CITY MANAGER OR HIS <br /> DESIGNEE TO SERVE AS AN ADMINISTRATIVE OFFICIAL FOR THE <br /> ADMINISTRATION AND ENFORCEMENT OF THE SAN MARCOS <br /> MUNICIPAL AIRFORT HAZARD ZONING ORDINANCE AS ADOPTED BY <br /> THE JOINT AIRroRT ZONING EDARD OF THE CITY OF SAN <br /> MARCOS, TEXAS, THE CITY OF MARTI NDALE, TEXAS, THE <br /> COUNTY OF CALDWELL, MARTINDALE, TEXAS, THE COUNTY OF <br /> CALDWELL, TEXAS, THE COUNTY OF HAYS, TEXAS, AND THE <br /> COUNTY OF GUADALUPE, TEXAS; AProINTING A MEMBER TO THE <br /> ED ARD OF ADJUSTMENT CREATED BY SAID SAN MARCOS <br /> MUNICIPAL AIRroRT HAZARD ZONING ORDINANCE AND DæLARING <br /> AN EFFæTIVE DATE. <br /> WHEREAS, the Joint Airport Zoning Board of the City of San Marcos, <br />Texas, the Ci ty of Martindale, Texas, the County of Caldwell, Texas, <br />the County of Hays, Texas, and the County of Guadalupe, Texas, has <br />adopted the San Marcos Municipal Airport Hazard Zoning Ordinance, which <br />provides therein that it shall be the duty of the City Manager of the <br />City of San Marcos, Texas, or the designee of the City Manager, to <br />administer and enforce the regulations prescribed therein, except for <br />such areas which fall within the city limits and extraterritorial <br />jurisdiction of the City of Martindale, Texas, and which provides for <br />and creates a Eoard of Adjustment to hear and decide appeals from any <br />order, requirement, decision, or determination made by said City <br />Manager or the designee of said City Manager and further provides that <br />the City Council of the City of San Marcos, Texas shall have the right <br />to appoint one member of the five (5) member Eoard of Adjustment, which <br />member shall serve for a term of two (2) years and be removable for <br />cause by the City Council of the City of San Marcos, Texas upon written <br />charges, after a public hearing; and <br /> WHEREAS, the San Marcos Airport Manager and the Airport Commission <br />of the City of San Marcos, Texas have reviewed the said provisions of <br />the San Marcos Municipal Airport Hazard zoning Ordinance, as well as <br />the entire said Ordinance, and recorru:œnd that the City Council of the <br />City of San Marcos, Texas, authorize the said City Manager or his <br />designee to administer and enforce the regulations prescribed in the <br />said Ordinance, except for such areas which fall within the city <br />limi ts and extraterritorial jurisdiction of the City of Martindale, <br />Texas and, further, that the City Council of the City of San Marcos, <br />Texas exercise its right under the said Ordinance to appoint a member <br />to the said Board of Adjustment by appointing Steve VanBuren <br />as such member, to serve for a term of two (2) years and be removable <br />for cause by the City Counc il of the City of San Marcos, Texas <br />upon written charges, after a public hearing; now, therefore, <br /> BE IT REffiLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> PART 1. That the City Manager of the City of San Marcos, Texas or <br />his designee shall administer. and enforce the regulations prescribed in <br />the San Marcos Municipal Airport Hazard Zoning Ordinance, adopted by <br />the Joint Airport ZOning Eoard of the City of San Marcos, Texas, the <br />City of Martindale, Texas, the County of Caldwell, Texas, the County of <br />Hays, Texas, and the County of Guadalupe, Texas on September 27, 1984. <br /> PART 2. That Steve VanBuren is hereby appointed to <br />serve as a member of the Board of Adjustment created by such San Marcos <br />Municipal Airport Hazard Zoning Ordinance for a term of two (2) years, <br />removable for cause by the Ci ty Council of the City of San Marcos, <br />Texas upon written charges, after a public hearing. <br /> PART 3.
