<br /> LEASE AGREEMENT
<br /> THIS AGREEMENT, made and entered into this 6 day of November ,
<br /> 19 84 by and between WILLIAM C. CARSON AND RONALD O. WILSON (dba
<br /> SPRINGTOWN CENTER), whose address is Post Office Box 666, San Marcos,
<br /> Texas 78666, hereinafter called LESSOR, and The City of San Marcos,
<br /> Texas, a municipal corporation located in Hays County, Texas and
<br /> existing by and under the laws of the State of Texas whose principal
<br /> address is at 630 East Hopkins, San Marcos, Texas 78666, acting through
<br /> authority conferred on its Mayor, Emmie Craddock, by Resolution duly
<br /> adopted on November 5 , 1984, hereinafter called LESSEE, witnesseth
<br /> that:
<br /> NOW, THEREFORE, in consideration of the rents to be paid and the
<br /> mutual covenants to be performed, the parties hereto agree as follows:
<br /> 1. DESCRIPTION
<br /> LESSOR desires to lease a building (hereinafter called "The
<br /> Premises"), containing approximately Two Thousand and Forty square feet
<br /> and being a part of the SPRINGTOWN TWO CENTER, which center is, or will
<br /> be located upon the following described real estate to-wit:
<br /> A portion of the J. M. Veramendi League No. 2, Hays County,
<br /> Texas; and more particularly described in Exhibit "B"--legal
<br /> description attached hereto.
<br /> LESSOR hereby leases to LESSEE and LESSEE hires from LESSOR the
<br /> premises hereinafter described and which are outlined in red on the
<br /> Shopping Center Plot Plan attached hereto as Exhibit "A" and
<br /> hereinafter called "the premises", and which are a part of the entire
<br /> area to be occupied by the Shopping Center as hereinabove described and
<br /> hereinafter called "Shopping Center". The premises are described as
<br /> follows, to-wit:
<br /> Fronting Sixteen feet by a depth of Sixty feet being in
<br /> the shape as shown on Exhibit "A" attached hereto
<br /> (any measurements herein specified being from the exterior of outside
<br /> walls and to the center of interior or common walls) together with all
<br /> improvements that have been or may be placed thereon.
<br /> 2. RETAINED RIGHTS
<br /> LESSOR reserves the right to place in the premises (in such manner
<br /> as not to interfere with LESSEE'S use thereof or to detract from the
<br /> appearance thereof) utility lines, plpes, and the like, to serve
<br /> premises other than the premises, and to replace and repair such
<br /> utility lines, pipes, and the like. Such replacement and repalr shall
<br /> be handled so as to interfere as little as possible with LESSEE'S use
<br /> of the premises, and LESSOR shall repair any damage caused by such
<br /> work.
<br /> 3. QUIET POSSESSION
<br /> The LESSOR covenants that it has good title to said real estate,
<br /> and that LESSEE, upon paying the rentals herein reserved and observing,
<br /> performing and keeping all and singular the covenants and agreements
<br /> herein specified to be kept and performed by LESSEE shall, and may
<br /> lawfully, peacefully, quietly and exclusively have, hold, use, occupy,
<br /> possess and enjoy the premises hereby leased for and during the term
<br /> hereof, without any hindrance, eviction, molestation, or interruption
<br /> of or by the LESSOR, or other person or persons.
