<br /> 25. RELA'I'IONSHIP
<br /> Nothing contained herein shall be deemed or construed by the
<br /> parties hereto, or by any third party, as creating the relation of
<br /> principal and agent or of partnership or of joint venture between the
<br /> parties hereto. It is understood and agreed that neither the method of
<br /> computation of rent, nor any other provision contained herein, nor any
<br /> acts of the parties hereto, creates a relationship other than the
<br /> relationship of LESSOR and LESSEE.
<br /> 26. COMMON FACILITIES AND AREAS
<br /> The Common Facilities and Areas of the Shopping Center are that
<br /> part of the Shopping Center designated by LESSOR from time to time for
<br /> the common use of all LESSEES, including among other facilities,
<br /> parking area, sidewalks, landscaping, curbs, truckways, delivery
<br /> passages, malls, loading areas (other than LESSEE'S loading dock),
<br /> private streets and alleys, lighting facilities, drinking fountains,
<br /> meeting rooms, public toilets, and the like, all of which shall be
<br /> subject to LESSOR'S sole management and control and shall be operated
<br /> and maintained in such manner as LESSOR in their sale discretion shall
<br /> determine. LESSOR reserves the right to change from time to time the
<br /> dimensions and location of the Common Facilities and Areas as shown on
<br /> Exhibiit "A", as well as the dimensions, identity, and type of any
<br /> buildings shown on Exhibit "A", and to construct additional buildings
<br /> or additional stories on existing buildings or other improvements in
<br /> the Shoppping Center, except that the parking areas provided by LESSOR
<br /> in the Shopping Center or in reasonable proximity thereto, shall
<br /> contain at all times after LESSOR has opened the leased premises to the
<br /> public for business, at least 5 parking spaces, for each 1,000 square
<br /> feet of retail selling space in the Shopping Center, adjusted and
<br /> weighted on the following basis: One hundred percent (100%) for all
<br /> ground floor space used for retail selling purposes; fifty percent
<br /> (50%) for all other space used for retail selling purposes¡ 2 spaces
<br /> per 1,000 square feet adjacent to Springtown Two Center with remainder
<br /> prov ided by cross-parking with Springto,,"m Center per Paragraph 4.
<br /> LESSOR further reserves the right to dedicate portions of the
<br /> Common Facilities and Areas, and other portions of the Shopping Center
<br /> (excepting only the Leased Premises) for street, park, utility, and
<br /> other public purposes. LESSOR, and its employees, customers,
<br /> sublessees, licensees, and concessionaires shall have the nonexclu!?ive
<br /> right to use the Common Facilities and Areas as constituted from time
<br /> to time, such use to be in common with LESSEE, other LESSEES in the
<br /> Shopping Center, and other persons entitled to use the same, and
<br /> subj ect .1..- such reasonable rules and regulations governing automobiles

<br /> owned by LESSEE, its employees, sublessees, licensees, and
<br /> concessionaires shall be parked. Upon request of LESSOR, LESSEE will
<br /> furnish to LESSOR a complete list of the license numbers of all
<br /> automobiles operated by LESSEE, its employees, sublessees, licensees,
<br /> or concessionaires. LESSEE shall not solicit business or display
<br /> merchandise within the Common Facilities and Areas, or distribute hand
<br /> bills therein, or take any action which would interfere with the rights
<br /> of other persons to use the Common Facilities and Areas. LESSOR may
<br /> temporarily close any part of the Common Facilities and Areas for such
<br /> periods of time as may be necessary to prevent the public from
<br /> obtaining prescriptive rights or to make repairs or alterations.
<br /> 27. UTILITIES
<br /> LESSEE agrees to pay all electric current, water, gas, and other
<br /> fuel bills, as determined by separate meters for LESSEE'S space and
<br /> use, and all taxes on equipment or property belonging to, or owned by
<br /> it, located upon the above-described premises. The LESSOR shall ensure
<br /> that the electrical installation and wiring meet applicable state and
<br /> local laws, ordinances, regulations and standard s and that electric
<br /> outlets be properly spaced, in accordance with said standard s ,
<br /> to afford maximum use of the office space. LESSOR shall
