<br /> A RESOLUTION OF THE CITY COUNCIL OF
<br /> THE CITY OF SAN MARCOS, TEXAS,
<br /> AUTHORIZING AND APPROVING THE TERMS
<br /> AND CONDITIONS OF A PROPOSED LICENSE
<br /> AGREEMENT BETWEEN SAID CITY AND STATE
<br /> BANK AND TRUST COMPANY OF SAN HARCOS,
<br /> TEXAS, AS TRUSTEE OF THE MAUDE T.
<br /> PATTERSON TRUST FOR THE PURPOSE OF
<br /> ALLOWING SAID CITY, ITS SUCCESSORS,
<br /> AGENTS AND REPRESENTATIVES AND ANY AND
<br /> ALL CONTRACTORS AND SUBCONTRACTORS
<br /> THEREOF, TO CONSTRUCT, INSTALL, USE
<br /> AND HAINTAIN UPON TRUSTEE'S PROPERTY
<br /> ELECTRONIC AND ELECTRICAL EQUIPHENT
<br /> AND STRUCTURES TO PROVIDE PRECISION
<br /> APPROACH PROCEDURES TO AIRCRAFT
<br /> UTILIZING RUNWAY 12 OF THE SAN MARCOS
<br /> MUNICIPAL AIRPORT; AUTHORIZING THE
<br /> MAYOR TO EXECUTE SAID AGREEMENT ON
<br /> BEHALF OF SAID CITY AND DECLARING AN
<br /> EFFECTIVE DATE.
<br />WHEREAS, State Bank and Trust Company of San Marcos, Texas
<br />presently holds certain real property in trust for Maude T.
<br />Patterson, by virtue of a deed dated September 10, 1974 from
<br />Maude T. Patterson to State Bank and Trust Company, as Trustee
<br />of the Maude T. Patterson Trust, of record in Volume 270, Page
<br />397 of the Deed Records of Hays County, Texas; and,
<br />WHEREAS, there is presently pending in the County Court
<br />At Law of Hays County, Texas, that certain eminent domain
<br />proceeding, being Cause No. 3595 and styled, The City of San
<br />Marcos, Texas v. Estate of Ohren R. Patterson, Deceased, Et Al,
<br />wherein said City, as Condemnor, is seeking to condemn certain
<br />interests in the real property referred to hereinabove; and,
<br />WHEREAS, the City Council of said City desires to enter
<br />into an agreement with said Bank in order that said City, its
<br />successors, agents and representatives and any and all con-
<br />tractors and subcontractors thereof, be allowed to construct,
<br />install, use and maintain upon said property electronic and
<br />electrical equipment and structures to provide precision
<br />approach procedures to aircraft utilizing Runway 12 of the San
<br />Marcos Municipal Airport; now, therefore,
<br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN
<br />l'1ARCOS, TEXAS:
<br />PART 1: That the terms and conditions of a proposed License
<br />Agreement between said City and State Bank and Trust Company
<br />of San Marcos, Texas, as Trustee of the Maude T. Patterson Trust,
<br />a copy of which is attached hereto and incorporated herein for
<br />all purposes, for the purpose of allowing said City, its suc-
<br />cessors, agents and representatives and any and all contractors
<br />and subcontractors thereof, to construct, install, use and
<br />maintain upon Trustee's property more particularly described
<br />therein electronic and electrical equi?ment and structures to
<br />provide precision approach procedures to aircraft utilizing
<br />Runway 12 of the San Marcos Municipal Airport, are hereby
<br />authorized and approved.
<br />PART 2. That the Mayor be, and she is hereby, authorized
<br />to execute said Agreement on behalf of said City.
<br />PART 3. That this Resolution shall be in full force and
<br />effect from and after its passage.
