<br /> 12 <br /> RESOLUTION 1984-108R <br /> A RESOLUTION OF THE CITY COUNCIL OF <br /> THE CITY OF SAN MARCOS, TEXAS, <br /> TERÞIINATING AND FORFEITING THAT LEASE <br /> AND OPERATING AGREEMENT OF MAY 7, 1984 <br /> BETWEEN SAID CITY AND NORTH AMERICAN <br /> AEROSPACE CORPORATION (NAAC) AND <br /> DECLARING AN EFFECTIVE DATE. <br /> WHEREAS, a Lease And Operating Agreement was entered <br /> into on May 7, 1984 between the City of San Marcos, Texas as <br /> Lessor and North American Aerospace Corporation (NAAC) as <br /> Lessee for the lease of premises at the San Marcos Municipal <br /> Airport; and, <br /> WHEREAS, said Lease And Operating Agreement provides <br /> that the Lessee submit to Lessor, for approval, within ninety <br /> (90) days from the date of said Agreement, detailed plans and <br /> specifications for all proposed leasehold improvements on the <br /> leased premises; and, <br /> WHEREAS, Lessee failed to submit such detailed plans and <br /> specifications within such ninety (90) day period and Lessee <br /> was subsequently notified on August 16, 1984 of its default <br /> under said Agreement in accordance therewith and given thirty <br /> (30) days to remedy such default; and, <br /> WHEREAS, on September 14, 1984 Lessee submitted materials <br /> to Lessor under cover of a letter describing such materials as <br /> "detailed plans"; and, <br /> WHEREAS, such materials are not detailed plans and <br /> specifications as required by said Agreement and Lessee is, <br /> therefore, still in default under said Agreement; now, <br /> therefore, <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS: <br /> PART 1. That, pursuant to the provisions of the Lease <br /> And Operating Agreement between said City and North American Aerospace <br /> Corporation (NAAC) datedylay 7, 1984, a copy of which Agreement <br /> is attached hereto and incorporated herein for all purposes, <br /> said Agreement is hereby terminated and forfeited and the said <br /> North American Aerospace Corporation (NAAC) shall have no <br /> further rights therein. <br /> PART 2.
