14 Compl lance Agr~elllellt City of San l'iarcos Permit No. \.0273-0 i This Compliance Agreement between the City of San t-tlrcos, P. - o. BOK 725, S<1n Marcos, Texas, and the Executive Director of the Texas Department of Water Resources (TDWR) represents a determination by the Executive Director that formal enforcement action pertaining to alleged violations of the Texas Solid Waste Disposal Act (Tex. Rev. Civ. Stat. Ann., Art. 4477-7 (Vernon Supp. 1984), as amended) and/or Chapter 26 of the Texas Water Code (Tex. Wate r Code Ann. (Vernon Supp. 1984))) as amended, will be withheld as long as the City of San Marcos, properly completes the acts required by this Agreelilent, in accordance with the terms herein) including the compliance schedule or an amended compliance schedule as approved by TDWR) and the terms of this Compliance Agreement. This Agreement does not constitute a waiver or modification of any applicable requirement of the TDWR. If the City of San Marcos) does not comply with all the terms of this Agreement) the TDWR may seek civil penalties and other relief for all violations, including those that occurred prior to the execution of this Agreement. 1. By January31, 1985, the City of San Marcos shall have installed at the site of their Sewage Treatment plant No. 2 a 0.500 MGD interim package treatment plant. 2. Upon installation or the interim ST\?, the City of San Marcos shall begin diverting flow from the No. 1 ST\? (Trickling Filter Plant) in such quantities as to obtain and then maintain compliance with Permit No. 10273-01. The diversion of wastewater from Plant No. 1 shall continue until Plant No. 1 1.S abandoned.
