BOK 725, S<1n <br /> Marcos, Texas, and the Executive Director of the Texas Department of Water <br /> Resources (TDWR) represents a determination by the Executive Director that formal <br /> enforcement action pertaining to alleged violations of the Texas Solid Waste <br /> Disposal Act (Tex. Rev. Civ. Stat. Ann., Art. 4477-7 (Vernon Supp. 1984), as <br /> amended) and/or Chapter 26 of the Texas Water Code (Tex. Wate r Code Ann. (Vernon <br /> Supp. 1984))) as amended, will be withheld as long as the City of San Marcos, <br /> properly completes the acts required by this Agreelilent, in accordance with the <br /> terms herein) including the compliance schedule or an amended compliance schedule <br /> as approved by TDWR) and the terms of this Compliance Agreement. This Agreement <br /> does not constitute a waiver or modification of any applicable requirement of the <br /> TDWR. If the City of San Marcos) does not comply with all the terms of this <br /> Agreement) the TDWR may seek civil penalties and other relief for all violations, <br /> including those that occurred prior to the execution of this Agreement. <br /> 1. By January31, 1985, the City of San Marcos shall have installed at the <br /> site of their Sewage Treatment plant No. 2 a 0.500 MGD interim package <br /> treatment plant. <br /> 2. Upon installation or the interim ST\?, the City of San Marcos shall begin <br /> diverting flow from the No. 1 ST\? (Trickling Filter Plant) in such <br /> quantities as to obtain and then maintain compliance with Permit No. <br /> 10273-01. The diversion of wastewater from Plant No. 1 shall continue <br /> until Plant No. 1 1.S abandoned. <br />
