29 ORDINANCE 1984-111 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING SECTION 2-43 OF DIVISION 2, ENTITLED "TEXAS MUNICIPAL RETIREMENT SYSTEM" OF ARTICLE III, ENTITLED "CIVIL SERVICE AND EMPLOYEE BENEFITS" OF CHAPTER 2 OF THE CODE OF ORDINANCES OF SAID CITY TO AMEND THE DATE ON WHICH CALCULATIONS OF UPDATED SERVICE CREDITS ARE BASED, UNDER THE ACT GOVERNING THE TEXAS MUNICIPAL RETIREMENT SYSTEM, FOR SERVICE PERFORMED BY QUALIFYING MEMBERS OF SUCH SYSTEM IN THE EMPLOYMENT OF SAID CITY AND TO AMEND THE DATE ON WHICH CALCULATIONS OF UPDATED SERVICE CREDITS ARE BASED UNDER SAID ACT FOR SERVICE PERFORMED BY QUALIFYING MEMBERS OF SUCH SYSTEM WHO HAVE UNFORFEITED CREDIT FOR P RI 0 R SERVICE AND/OR CURRENT SERVICE WITH OTHER PARTICIPATING MUNICIPALITIES BY REASON OF PREVIOUS SERVICE AND WHO WERE CONTRIBUTING MEMBERS ON JANUARY 1, 1984; AMENDING SECTION 2-44(b) OF SAID DIVISION OF SAID ARTICLE OF SAID CHAPTER OF SAID CODE TO AMEND THE DATE ON WHICH CALCULATIONS OF THE INCREASE IN RETIREMENT ANNUITIES ARE BASED; AMENDING SAID DIVISION OF SAID ARTICLE OF SAID CHAPTER OF SAID CODE TO ADD A SECTION TO BE NUMBERED 2-49 TO PROVIDE FOR SEPARABILITY; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That Section 2-43 of Division 2 of Article III of the Code of Ordinances of the City of San Marcos, Texas, is hereby amended to read as follows: Sec. 2-43. Authorization of updated service credit. ( a) On the terms and conditions set out in Sections 63.403 of Title 110B, Revised Civil Statutes of Texas, 1925, as amended, each member of the Texas Municipal Retirement System who has current service credit or prior service credit in said System in force and effect on the 1st day of January, 1985, by reason of service in the employment of the City of San Marcos, and on such date has at least 36 months of credited service with said System, shall be and is hereby allowed "Updated Service Credit" (as that term is defined in subsection (d) of Section 63.402 of said Title) in an amount that is 100% of the "base Updated Service Credit" of the member (calculated as provided in subsection (c) of Section 63.402 of said Title). The Updated Service Credit hereby allowed shall replace any Updated Service Credit, prior service credit, special prior service credit, or antecedent service credit previously authorized for part of the same serVlce.
