<br />SHOPPING CENTER LEASE <br /> <br />This Lease is entered into as of the \~~l day of September, 2007 by and between the Landlord and the <br />Tenant hereinafter named. <br /> <br />ARTICLE I. <br /> <br />Section 1.1. Fundamental Lease Provisions <br /> <br />(a) <br /> <br />LANDLORD: <br /> <br />Sendero Plaza Highway LLC <br /> <br />(b) <br /> <br />AGENT: <br /> <br />Joe M. Hopkins <br />San Marcos, TX 78666 <br /> <br />(e) <br /> <br />TENANT'S TRADENAME: <br /> <br />WIC Program <br /> <br />(f) DEMISED PREMISES: Approximately 2,700 square feet in area (measured to the exterior of <br />outside building walls, and to the center of interior demising walls), being a portion of the Shopping Center <br />constructed or to be constructed on part of the real property described in Exhibit "A" attached hereto the Demised <br />Premises (herein sometimes called the "premises") to be situated or being situated substantially in the location which <br />is shown outlined in red on the attached Exhibit "A" and identified as Suites 1409, consisting of approximately <br />1,200 square feet and 1405, consisting of approximately 1,500 square feet. The term "Shopping Center", as used <br />herein, shall refer to the real property described in Exhibit "A" and any existing and future buildings, parking areas, <br />sidewalks, service areas and other improvements which may be designated by Landlord, from time to time. <br /> <br />(g) LEASE POSSESSION DATE: Shall be the date Landlord and Tenant fully execute the Lease <br />Agreement. Upon full execution ofthe Lease, Landlord shall tender possession of the Demised Premises to Tenant <br />(the "Possession Date"). <br /> <br />(h) LEASE\RENT AL COMMENCEMENT DATE: October 1, 2007 <br /> <br />(i) TERM: Sixty Months (60) Months thereafter; provided that if the Commencement Date is a <br />date other than the first day of a calendar month, then see Article IV, Section 4.2. <br /> <br />(j) THE TENANT AGREES TO PAY THE FOLLOWING MINIMUM GUARANTEED RENTAL: <br /> <br />Years One & Two: <br />Year Three: <br />Year Four: <br /> <br />$10.80 psf NNN annually, payable in monthly installments of$2,430.00 <br />$11.12 psf NNN annually, payable in monthly installments of$2,502.90 <br />$11.45 psfNNN annually, payable in monthly installments of $2,577.99 <br /> <br />INITIALS:'\{:, ((\1 <br />~ <br /> <br />6 <br />
