RESOLUTION 2007- 160 R

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS,
TEXAS FINDING 52 VHS VIDEO RECORDING SYSTEMS UTILIZED BY
THE CITY'S POLICE PATROL VEHICLES TO BE SURPLUS AND OF NO
VALUE TO THE CITY OF SAN MARCOS; AUTHORIZING THE POLICE
DEPARTMENT TO DONATE THESE VHS SYSTEMS TO OTHER LAW
ENFORCEMENT AGENCIES; AND DECLARING AN EFFECTIVE DATE.

RECITALS:

1. In 2003 the City received a grant from the Texas Department of Public Safety
("DPS") for the acquisition of 52 VHS video recording systems (the "VHS systems") for the San
Marcos Police Department's police patrol vehicles.

2. In 2007 the Police Department replaced those original VHS systems with digital
systems which renders the VHS system obsolete and of no value to the City.

3. The Police Department has already donated several of the VHS systems to San
Marcos Fire and Rescue and to the San Marcos Marshal's office and has determined that there
are no further intra-City requests.

4. The City has determined that these VHS systems are surplus and of no value to
the City and wish to donate them to other law enforcement agencies in keeping with the original
DPS grant terms and condition.

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS,
TEXAS:

PART 1. The City Council finds and determines that these VHS video systems utilized
by the San Marcos Police Department's patrol vehicles are surplus and of no value to the City of
San Marcos.

PART 2. The Police Department is authorized to donate these VHS systems to other law
enforcement agencies.

PART 3. The City Manager, Dan O'Leary, is authorized to execute any necessary
documents facilitating the transfer of the VHS systems.

PART 4. This Resolution shall be in full force and effect immediately from and after its
passage.
