<br /> ll6 <br /> REPORT OF THE <br /> 1982 CHARTER REVIEW COMMISSION <br /> We, the undersigned members of the 1982 Charter Review <br /> Commission for the City of San Marcos, Texas, have completed <br /> our review of the operation of the city government as prescribed <br /> in the current San Marcos City Charter in Section l2.12. We <br /> hereby propose the following amendments to the Charter: <br /> I. Article II. Powers of the City <br /> A. Section 2.03. Extension or Detachment of Boundaries. <br /> It is recommended that the section be rewritten to con- <br /> form to current state law. <br /> Proposed wording: <br /> (a) The City Council shall have power by ordinance <br /> to fix the boundary limits of the City of San ~1arcos; <br /> and to provide for the alteration, and extension, of <br /> said boundary limits, the detachment of territory, <br /> and the annexation of additional territory lying <br /> adjacent to the City, with or without the consent of <br /> the territory and inhabitants annexed or detached. <br /> Before the City may institute annexation or detachment <br /> proceedings the City Council shall provide an opportu- <br /> nity for all interested persons to be heard at two <br /> public hearings to be held not more than forty (40) <br /> days nor less than twenty (20) days prior to institu- <br /> tion of such proceedings. At least one (l) public <br /> hearing shall be held within the area proposed to be <br /> annexed. Notice of such hearing shall be published <br /> in a newspaper having general circulation in the City <br /> and in the territory proposed to be annexed or detached. <br /> The notice shall be published at least once in such <br /> newspaper not more than twenty (20) days nor less than <br /> ten (10) days prior to the hearing. Additional notice <br /> by certified mail should be given to railroad companies <br /> then serving the City and on the City's tax roll where <br />
