<br /> l39 <br /> RESOLUTION NO. 1983-6R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE <br /> CITY OF SAN .f\1ARCOS, TEXAS, APPROVING THE <br /> TERMS AND CONDITIONS OF AN AGREEMENT FOR <br /> EXCHANGE OF PROPERTY BETWEEN SAID CITY AND <br /> THE BOARD OF REGENTS, TEXAS STATE UNIVERSITY <br /> SYSTEM; AUTHORIZING THE MAYOR OF SAID CITY <br /> TO EXECUTE SAID AGREEMENT ON BEHALF OF SAID <br /> CITY AND DECLARING AN EFFECTIVE DATE. <br /> WHEREAS, the City of San Marcos, Texas, wishes to exchange <br /> certain real property owned by it with other real property <br /> owned by the State of Texas; and, <br /> WHEREAS, the State of Texas is agreeable to said exchange; <br /> and, <br /> WHEREAS, said City and the State of Texas also desire <br /> to make certain arrangements for access to San Marcos City Park <br /> and for use of City Park property by Southwest Texas State <br /> University for a practice athletic field at times that do not <br /> conflict with City's use; now, therefore, <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN <br /> ~.1ARCOS, TEXAS: <br /> PART 1. That the Agreement For Exchange of Property <br /> between the City of San Marcos, Texas, and the State of Texas, <br /> a copy of which agreement is attached hereto and incorporated <br /> herein for all intents and purposes, is hereby approved in all <br /> respects. <br /> PART 2. That the Mayor of the City of San Marcos, Texas, <br /> Emmie Craddock, be, and she is hereby, authorized to execute <br /> said agreement. <br /> PART 3.
