19. Providing notice to the City of any damage caused to the Facility by fire or other casualty. <br />20. Securing the advance written consent of Caroline and the City as to any sublease of its interest In <br />the Facility. <br />21. Events of default and remedies. <br />22. Not engaging in unlawful discrimination in the conduct of the business operations, use of the <br />Facility, or employment activities. <br />23. Furnishing services on a fair, equal, and nondiscriminatory basis to all users, and charging fair, <br />reasonable, and nondiscriminatory prices for each unit or service. Corp Jet may offer reasonable <br />and nondiscriminatory discounts, rebates or similar price reductions to volume purchasers. <br />Section 12. City's Reserved Rights. <br />1. The City reserves the right to operate the Airport in accordance with and this Agreement is <br />subordinate to, the City's obligations to the Federal and State governments under any of the <br />agreements for which aid for development of the Airport was or will be granted. If these <br />obligations unreasonably restrict Corp Jet's use of the Facility, then Corp Jet may terminate this <br />agreement, and the parties will have no further obligations. <br />2. It is specifically understood and agreed that this Agreement does not grant or authorize an <br />exclusive right for conducting any aeronautical activity which is unlawfully discriminatory. Corp <br />Jet specifically agrees not the discriminate in its use of the Facility in any manner prohibited by <br />Federal Aviation Administration Regulations. Corp Jet further agrees to comply with any <br />nondiscrimination enforcement procedures required by the Federal or State government. <br />3. The City reserves the right to take any action it considers necessary to protect the aerial <br />approaches of the Airport against obstructions; and to limit Caroline and Corp Jet from erecting <br />any building or structure on the Airport or on the Property that would limit the usefulness of the <br />Airport or constitute a hazard to aircraft. <br />4. The City reserves the right to further develop the Airport as it sees fit regardless of the desires of <br />Caroline and Corp Jet, and without any hindrance or interference from Caroline and Corp let. The <br />City expressly reserves the right to grant leases and privileges to other persons with respect to <br />the Airport, even though the purposes for which these leases are given are the same duplicate <br />those contained in this Agreement. <br />5. During the time of war or national emergency, the City shall have the right to lease all or part of <br />the landing areas at the Airport to the Federal government for military use, and, if a lease is <br />executed, the provisions of this Agreement shall be suspended to the extent they are inconsistent <br />with the provisions of the lease to the Federal government. <br />6. The City shall have the right to enter the Facility at all reasonable hours for the purpose of <br />inspection. The City shall not be liable to Corp Jet for any expense, loss, or damage from any such <br />entry upon the Facility. <br />
