i ORDINANCE NO. 2014 - 21 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, CREATING A DESIGNATED PERMIT AREA UNDER SECTION 82.189 OF THE SAN MARCOS CITY CODE AUTHORIZING PARKING BY PERMIT ONLY FOR THE AREA CONSISTING OF: THE 600 BLOCK OF BURT STREET (FROM MAURY STREET TO THE END OF BURT STREET); THE 600 AND 700 BLOCKS OF MAURY STREET (FROM ROGERS STREET TO BURT STREET) AND THE 500 BLOCK OF HANSON STREET (FROM BLANCO STREET TO MAURY STREET); AMENDING THE TRAFFIC REGISTER TO REFLECT SUCH DESIGNATED PERMIT AREA; AND PROVIDING FOR AN EFFECTIVE DATE. 1. CHAPTER 82, SECTION 189 OF THE SAN MARCOS CITY CODE authorizes the creation of a Designated Permit Area upon the request of a property owner whose property abuts the requested Designated Permit Area, the submittal of a petition and fulfillment of the requirements of Section 82.189(b) of the San Marcos City Code; 2. The San Marcos Transportation Department has received a request and a petition for the creation of a Designated Permit Area from the residents of the proposed Designated Parking Area which is identified and described as: the 600 Block Burt Street (from Maury Street to the end of Burt Street); the 600 and 700 Blocks of Maury Street (from Rogers Street to Burt Street) and the 500 Block of Hanson Street (from Blanco Street to Maury Street and depicted in the map attached hereto and incorporated herein for all purposes as Exhibit B The petition which is signed by sixty percent of all single family houses and four -plex or smaller rental properties located within the Designated Permit Area and that meets the requirements of Section 82.189(b) is attached hereto as ambit -A and incorporated herein for all purposes. 3. City Transportation Department staff recommends the creation of this Designated Parking Area which will restrict parking to permit parking from 8AM to 5 PM, Monday through Friday. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. Findings. All of the above premises are hereby found to be true and correct legislative and factual findings of the City Council of San Marcos, and are hereby approved and incorporated into the body of this Ordinance as if copied in their entirety. SECTION 2. A public hearing as required by Section 82.189(d) of the San Marcos City Code was held on April_, 2014 on the application. SECTION 3.
