Comments on PDD <br /> a Allow bufferyards to be conveyed as easements and not <br /> only as platted lots. <br /> COHMENT: If bufferyards were easements they would be part of <br />a lot. The owner of the lot might be responsible for its <br />maintenance. There may be many "owners" of the bufferyard. This <br />situation would not lend itself to consistent, proper maintenance <br />and could lead to possible conflicts among "easement owners" over <br />maintenance. The PDD now proposes a single entity being <br />responsible for proper and consistent maintenance of all <br />bufferyards. Enforcement of the bufferyards maintenance is much <br />simplified by dealing with a single entity than with all the <br />bufferyard owners on an individual basis. <br /> b. Do not require the perimeter bufferyard when the PDD is <br /> con-t iquous to vacant land and require the vacant land <br /> developer to buffer if buffering is necessary, later <br /> when he developes. <br /> COMMENT: Only PDD S or mixed use subdivisions are required <br />to buffer. In order to effectuate this idea, all developement that <br />was different from an existing use category would have to provide <br />bufferyards. <br /> The first person to propose a use requiring a bufferyard <br />should put the bufferyard in place. <br /> c. The Council may require the use of low water use <br /> landscaping in bufferyards. <br />
