City Attorney <br />Hankins advised he had concerns about Paragraph VI of the contract. <br />Mayor Craddock tabled adoption of the Resolution to the July 22, 1985 <br />Council Meeting and Mr. Guerra seconded the motion, which passed <br />unanimously. <br /> <br />Mayor Craddock introduced for consideration authorization for publica- <br />tion and notice of requests for Applications for the City's depository/ <br />depositories' contract. Mr. Coddington moved to amend such authoriza- <br />tion for a report to come to the Council on the applications received <br />and Mr. Farr seconded the motion, which passed unanimously. The Council <br />then voted unanimously for approval for authorization. <br /> <br />Mayor Craddock introduced for consideration approval to endorse the State <br />Department of Highways and Public Transportation funding and construction <br />of a 4-foot wide bicycle lane on each side of Aquarena Springs Drive, <br />and approval of a letter to be signed by Mayor Craddockendorsing the <br />same. The information provided to the Council prior to the meeting <br />indicated the State would fund the bicycle lanes, but Mr. Delbert <br />Chance advised Rodney Cobb the day of the meeting, the State had no <br />intention to funding the bicycle lanes but would agree to have the <br />bicycle lanes included in their construction design for improvements <br />to Aquarena Springs Drive. Mr. Farr moved a letter be forwarded from <br />Mayor Craddock to the State recommending they fund the bicycle lanes <br />and Ms. Kissler seconded the motion, which passed unanimously. <br /> <br />Mayor Craddock introduced for consideration approval of Change Order <br />No.7 in the amount of $17,852.00 to supply and install a transformer <br />for the Wastewater Treatment Plant. Mayor Craddock moved for approval <br />and Mr. Coddington seconded the motion, which passed unanimously. <br /> <br />Mayor Craddock introduced a report regarding the condition and rehabili- <br />tation plan for the Sessom wastewater line. Mr. Farr expressed concern <br />therewere portions of the line that had not been taped and the informa- <br />tion on those portions was not included in the report. Ray Longoria <br />advised there were portions of the line that were not taped but that <br />it would make no difference, as the size of the line was insufficient <br />for the capacity anyway in certain areas. He stated after the design <br />work is completed it would take approximately 90-120 days for construction <br />completion of Phase 1 and 180-200 days for completion of Phase 2. After <br />much discussion the Council directed an Emergency Meeting be scheduled <br />July 9, 1985 at 5:00 p.m. for a decision on how the Staff is to proceed <br />on this matter. <br /> <br />Mayor Craddock moved the Council adjourn into Executive Session pursuant <br />to Article 6252-17, §§2(e), (f) and (g), V.A.C.S., to seek the City At- <br />torney's advice with respect to pending litigation (McDonald vs. City) <br />and matters where the duties of the City Attorney to the City pursuant <br />to the Code of Professional Responsibility of the State Bar of Texas <br />clearly conflicts with Article 6252-17; the purchase of real property; <br />and complaints or charges against a public officer or employee, respective- <br />ly, and Ms. Kissler seconded the motion, which passed unanimously (10:42 <br />p.m.). <br /> <br />Mr. Farr moved the Council reconvene at 11:58 p.m. and Mr. Coddington <br />seconded the motion, which passed unanimously. <br /> <br />Mayor Craddock introduced for consideration approval for authorization <br />for a change in the Public Utility Commission Application for Certificate <br />of Convenience and Necessity to supply water services in portions of <br />the City's ~raterritorial jurisdiction (as approved by the Council <br />June 10, 1985). Mr. Coddington moved for approval and Mayor Craddock <br />seconded the motion, which passed unanimously, a copy of the map being <br />attached to these minutes. <br />
