<br /> A RESOLUTION OF THE CITY COUNCIL OF THE
<br /> CITY OF SAN MARCOS, TEXAS, APPROVING FI-
<br /> NAL PAYMENT TO JOHN M. HUDSON DBA J & S
<br /> EXCAVATION OF KYLE, TEXAS, FOR GENERAL
<br /> CONSTRUCTION WORK FOR SIDEWALK IMPROVE-
<br /> MENTS ON PATTON, VALLEY AND CENTRE STREETS
<br /> IN SAID CITY; ACCEPTING SAID IMPROVEMENTS
<br /> FOR USE BY SAID CITY; AUTHORIZING FINAL
<br /> PAYMENT IN THE AMOUNT OF $2,263.04 AND
<br /> DECLARING AN EFFECTIVE DATE.
<br /> WHEREAS, the City of San Marcos, Texas, has engaged the
<br /> services of John M. Hudson, dba J & S Excavation of Kyle,
<br /> Texas, for the construction of sidewalk improvements on Patton,
<br /> Valley, and Centre Streets, in said city, said project being
<br /> known as Victory Gardens Sidewalks, Phase II and being HUD
<br /> Community Development Block Grant No. B-79-HS-48-0505; and,
<br /> WHEREAS, said construction services were provided pursuant
<br /> to a contract between the City of San Marcos, Texas, and John
<br /> M. Hudson, dba J & S Excavation,entered into on March 11, 1983;
<br /> and,
<br /> WHEREAS, on May 5, 1983, Bill McCauley, Superintendent
<br /> of Public Works for the City of San Marcos, Texas, conducted a
<br /> final inspection of said project and found said construction to
<br /> have been completed in substantial compliance with the terms
<br /> and conditions of said contract of March 11, 1983 between John
<br /> M. Hudson, dba J & S Excavation,and said city; now, therefore,
<br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN
<br /> MARCOS, TEXAS:
<br /> PART 1. That construction for sidewalk improvements on
<br /> Patton, Valley and Centre Streets in the City of San Marcos,
<br /> Texas, has been completed in substantial compliance with that
<br /> contract of March 11, 1983 between John M. Hudson, dba J & S
<br /> Excavation,and the City of San Marcos, Texas, and said improve-
<br /> ments are hereby accepted for use by the City of San Marcos,
<br /> Texas.
<br /> PART 2. That final payment in the amount of $2,263.04
<br /> to John M. Hudson, dba J & S Excavation, in full and final
<br /> payment for general construction work for sidewalk improve-
<br /> ments on Patton, Valley and Centre Streets in the City of
<br /> San Marcos, Texas, is hereby authorized.
<br /> PART 3. That this Resolution shall become effective
<br /> immediately from and after its passage.
