<br /> 58 <br /> ORDINANCE NO. 1983-35 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br /> OF SAN MARCOS, TEXAS, ESTABLISHING A 60- <br /> DAY MORATORIUM ON THE PROCESSING OF APPLICA- <br /> TIONS FOR SPECIFIC USE PERMITS AND CONDITIONAL <br /> USE PERMITS FOR ESTABLISHMENTS DESIRING TO <br /> DISPENSE ALCOHOLIC BEVERAGES WITHIN THAT AREA <br /> KNOWN AS THE CENTRAL BUSINESS AREA OF SAID <br /> CITY BEYOND BEING ACCEPTED FOR FILING AND <br /> ESTABLISHING AN EFFECTIVE DATE. <br /> WHE REAS, the City Council of the City of San Marcos, Texas, <br /> lS considering the prohibition or limitation of the location of <br /> establishments which intend to dispense alcoholic beverages <br /> within that area of San Marcos known as the Central Business <br /> Area; and, <br /> WHE REAS, on May 9, 1983, said City Council adopted an <br /> ordinance establishing a temporary 60-day moratorium on the <br /> processing of applications for specific use permits and conditional <br /> use permits for establishments desiring to dispense alcoholic <br /> beverages within said area so that the City would have an adequate <br /> period of time within which to determine and adopt desirable <br /> regulations for property in said area; and, <br /> WHE REAS, though diligent effort has been expended, the City <br /> needs an additional period of time to examine and investigate <br /> the matter before making a decision on the issue of prohibiting <br /> or limiting the location of establishments which intend to dis- <br /> pense alcoholic beverages within said area; now, therefore, <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> SECTION 1. That no specific use permit or conditional <br /> use permit application for an establishment which desires to <br /> dispense alcoholic beverages within that area of the City of <br /> San Marcos, Texas, known as the Central Business Area shall be <br /> processed beyond being accepted for filing for a period of 60 <br /> days subsequent to the effective date of this Ordinance. <br /> SECTION 2. That for the purposes of this Ordinance the <br /> portion of the City of San Marcos, Texas, which is within the <br /> Central Business Area shall be as designated in that Ordinance <br /> of May 9, 1983 which established a temporary 60-day moratorium <br /> on said processing and which is shown on Exhibit "A" attached <br /> hereto and made a part hereof. <br /> SECTION 3. That the importance of this Ordinance creates <br /> an emergency and an imperative purpose necessary that the provisions <br /> of the charter requiring that ordinances shall be read at three <br /> separate meetings and that no ordinance shall become effective <br /> until the expiration of ten (10) days following the date of its <br /> final passage be suspended, and these provisions are hereby sus- <br /> pended, and this Ordinance shall take effect and be in full force <br /> and effect from and after its adoption and publication in a <br /> newspaper of general circulation within the City. <br /> PASSED, APPROVED, AND ADOPT~a of July , 19 83 . <br /> At est: Emmie Craddock <br /> Mayor <br /> ~~~ <br /> B~rbara Jea Edw rds <br /> Clty Attorn y <br /> Published in the DAILY RECORD July 20, 1983. <br />
