<br />127 <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />Special Meeting July 29, 1985 Page 2 <br /> <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, DECLARING A MORATORIUM UNTIL DECEMBER <br />31, 1985, ON THE CONSTRUCTION OF AND BUILDING PERMITS <br />FOR OUTDOOR ADVERTISING SIGNS ANYWHERE WITHIN THE CITY <br />LIMITS OF THE CITY OF SAN MARCOS; DECLARING THE PURPOSE <br />OF THIS ORDINANCE TO BE REMEDIAL¡ AND DECLARING AN EMER- <br />GENCY. <br /> <br />Mayor Craddock moved for adoption of the Ordinance on emergency and <br />Ms. Kissler seconded the motion. Mr. Coddington stated he thought the <br />Ordinance was too restrictive. Mr. Farr moved to amend the Ordinance <br />for the caption to reflect "OFF-PREMISE" OUTDOOR ADVERTISING SIGNS. . . <br />and Mr. Coddington seconded the motion, which passed unanimously. <br />Mr. Coddington moved to amend the Ordinance in Section 1 as follows: <br />. . . "[N]o building permits shall be issued for off-premise outdoor <br />advertising signs anywhere within the city limits of the City of San <br />Marcos, except for those signs for which applications for building <br />permits were on file on July 26, 1985¡ to delete Section 2 in its <br />entirety and renumber Sections 3 and 4 to Sections 2 and 3, respectively. <br />Ms. Kissler seconded the motion, which passed unanimously. The Council <br />then adopted the Ordinance on emergency unanimously. <br /> <br />Mayor Craddock introduced for consideration approval of an Ordinance <br />on second reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, ADDING CHAPTER 36 ENTITLED SAN MARCOS <br />RIVER CORRIDOR TO THE CODE OF ORDINANCES OF SAID <br />CITY¡ DECLARING THE PURPOSE OF THIS LEGISLATION TO <br />BE REMEDIAL¡ AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Farr moved for approval of the Ordinance on second reading and Mayor <br />Craddock seconded the motion. Mayor Craddock moved to amend the Ordin- <br />ance on Page 8 in Section 4.D. to delete the wording following total <br />suspended solids, ~ð~al-à~ssðlveà-sðl~às and fecal coliform. . . and <br />Ms. Kissler seconded the motion, which passed unanimously. Mayor <br />Craddock moved to amend the Ordinance on Page 5 in Section C.l.a. at <br />the end of the paragraph to add the following underlined wording: <br />" . . . City Council which shall consider the site plan at its next <br />meeting held at least seven (7) days from filing of the appeal with <br />the City Secretary~ Mr. Farr seconded the motion, which passed unani- <br />mously. Mayor Craddock moved to amend Page 10, Section 9.A. to add <br />the following underlined word: "... the existing natural land surface <br />shall be considered as impervious cover. . . ." Ms. Kissler seconded <br />the motion, which passed unanimously. The Council then voted unanimously <br />for approval of the Ordinance on second reading. During discussion of <br />this Ordinance and its amendments, the Council by consensus stated it <br />was their intent with the wording of Section 9.A., that it be interpreted <br />to mean the natural land surface as it exists naturally, rather than <br />as could be cut down and then seek an impervious cover. As stated by <br />the City Attorney, "You cannot cut down a hillside in order to increase <br />your impervious cover." <br /> <br />Mayor Craddock introduced for consideration approval of three Ordin- <br />ances on second reading and adoption of one Ordinance on third and final <br />reading by consensus. Mr. Coddington moved to approve the three Ordin- <br />ances on second reading and adoption of one Ordinance on third and final <br />reading by consensus and Ms. Kissler seconded the motion, which passed <br />unanimously.
