<br /> 1. N52°12'14"E 114.00 feet to a fence post for
<br /> the east corner of the telephone company
<br /> tract as fenced and used upon the ground,
<br /> 2. N 37°32'53"W 141.19 feet to the PLACE OF
<br /> BEGINNING. There are contained within
<br /> these metes and bounds 57.67 acres.
<br /> WHEREAS, notices of said public hearings were published
<br /> in the San Marcos Daily Record, a newspaper having general
<br /> circulation in said city and in the territory proposed for
<br /> annexation, on May 29, 1983 , and May 31, 1983 ,
<br /> respectively, said dates being not more than twenty (20) days
<br /> nor less than ten (10) days prior to the hearing for which
<br /> notice was given; and,
<br /> WHEREAS, prior to the publication of notice of said hear-
<br /> ings, the City Council of the City of San Marcos, Texas, directed
<br /> preparation of a service plan that provides for the extension
<br /> of municipal services to said ar~éfprGposedforannexation; and
<br /> WHEREAS, said proposed service plan was made available
<br /> for inspection and explained to the inhabitants of the area to
<br /> be annexed at said public hearings; and,
<br /> WHEREAS, said approximately 57.67 acres, more or less, are
<br /> located within the extraterritorial jurisdiction of the City of
<br /> San Marcos, Texas, and not within the extraterritorial jurisdiction
<br /> of any other city; and,
<br /> WHEREAS, said approximately 57.67 acres, more or less, are
<br /> contiguous and adjacent to the current boundaries of the City of
<br /> San Marcos, Texas; now, therefore,
<br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN
<br /> MARCOS, TEXAS:
<br /> SECTION 1. That the following described property, approx-
<br /> imately 57.67 acres, more or less, adjoining the existing city
<br /> limits of the City of San Marcos, Texas, out of the J.M. Veramendi
<br /> League No. 1, A-17 and the James Curtis Survey A-3, Hays County,
<br /> Texas, being a portion of that 38 acre tract described in a deed
<br /> from Rogers C. Wilson, et ux, to Rosemary Wilson McTaggart dated
<br /> December 15, 1967 and recorded in Volume 221, Page 230 of the
<br /> Hays County Deed Records and being a portion of that 45 acre
<br /> tract described in a deed from Rogers C. Wilson, et ux, to Rogers
<br /> D. Wilson dated December 15, 1967 and recorded in Volume 221,
<br /> Page 232 and later corrected in Volume 255, Page 208 of the Hays
<br /> County Deed Records, and being more particularly described by
<br /> metes and bounds as follows, to-wit:
<br /> BEGINNING at a fence corner post for the northerly
<br /> west corner of the McTaggart 38 acre tract, the
<br /> apparent north corner as fence of that 0.381 acre
<br /> tract described in a deed from Jennie Wood Whaley
<br /> to Southwestern Bell Telephone Company, as recorded
<br /> in Volume 124, Page 256 of the Hays County Deed
<br /> Records and being on the southeast line as fenced
<br /> of that 189 acre tract described in a deed from W.E.
<br /> Logan, et ux, to the State of Texas dated June 24,
<br /> 1946 as recorded in Volume 135, Page 414 of the Hays
<br /> County Deed Records, and being in the northwest line
<br /> of a 10 foot aerial easement granted to the Lower
<br /> Colorado River Authority described in Volume 224,
<br /> Page 522 of the Hays County Deed Records;
<br /> THENCE with the meanders of a fence for the common
<br /> line, as fenced and used upon the ground, of the
<br /> State of Texas tract and the McTaggart tract the
<br /> following five courses:
